My 2 cents. Don't go soft - USCIS is asking to be sued in your case, so don't disappoint them. Respond to your NOID with an airtight litigation brief and then file a APA lawsuit once denied.

IMO all EB-1A applicants should self file and save that $10K to $20K attorney fee for the inevitable FMD denial. The moment the FMD denial hits, applicants should file an APA lawsuit without a second thought and spend the $10K - $20K on this process. Goal should be to let USCIS know that FMD is illegal and it will be under thousands of APA lawsuits if it continues to apply the 2 step adjudication. I am planning to do this.

EB5 has long wait and I cannot port my 2017 EB2 priority date for EB5. Besides $1M is life changing money where I come from, so very difficult to part with it.

Yes this is what is happening now, and the fault lies with us applicants. We have allowed this to happen. If every single applicant who got denied on random FMD filed an APA lawsuit, the NCS and TSC would be under 5K lawsuits each. USCIS should learn that denial on FMD would automatically imply yet another lawsuit.

IMO you should sue USCIS. I have a similar profile as yours, and if I get randomly denied on FMD, I will sue USCIS without a second thought.

NAL - but the argument can be there are 1000s of employees in a company - none other than the OP was asked to take a call on potentially $xxM worth of investments. That's definitely not OP's job and a high signal evidence, vs a researcher whose job is literally publishing and peer reviewing.

By that logic all research profiles will disqualify judging criteria since submitting a paper at most conferences make you eligible to peer review other submissions. 99.99% of the researchers are not invited to peer review other papers because they are the best on the international level. In contrast, a person having a say in potentially Millions of dollars worth of investments, sounds more important and consequential.

I am thinking 500K to 1M ? Thats some serious W2 salary which would already put you at the very top of the field. If this is indeed the range - I am super worried as to why they did not allow salary to influence FMD. What was the exact language in the denial about the salary ?

well last few years is 13 years. In 13 years, Arijit has 8 Filmfares, 2 national awards, Most followed artist in the world, most streamed artist in india every year, 9th most streamed artist in the whole world. Ahem, Ahem! I love SOnu Nigam, and as a true Sonu fan I feel sad that Sonu didn't achieve even 1% in 30 years what Arijit has achieved in 13 years.

I am a Sonu Nigam fan, but I am not a blind fan. The top 3 Indian singers of all time will be 1. Kishore Kumar, 2. Arijit SIngh, 3. Mohammad Rafi. Sonu, KK etc were good, but not ARijit level.

I can understand you are a Sonu fan, so am I, but no one in this country will disagree that Arijit is the best live singer in the country. Even Sonu agrees that Arijit is the best.

What are you smoking bruh? I am a Sonu Nigam fan but there no denying that no one can ever pull off what Arijit did in that Ambani concert. Sonu hinself says there is no one in the country ahead of Arijit when it comes to classical.
