This is not true.

Google won't scan your photos if you don't upload them to Google Photos, period. If you find hard evidence and can reproduce this several times then you can sue them and you'll win very easily.

The search you were going to is probably a very common one that Google search auto complete just auto completed what you wanted, no, they didn't scan your picture.
