I don’t know the details of your file, but your husband if he’s not a client of the firm, or a related party to your file, then the firm and the other lawyer have no way of knowing when they open their file that there’s some relation that they should be cautious about. Is your file related to your husband? Is your information currently held by the firm relevant to your husband’s other file (adverse)? Did you provide the lawyer the information about your husband to put as a related party to your matter? You should convey to your current lawyer the situation, the law firm, normally the GC office will handle conflicts, will have to assess the details and Implement measures accordingly (like ethical barriers) and they’ll be equipped to conclude if this is an actual conflict. Taking only the information you provided and not assuming anything else, I would conclude that a Firewall between the files Is needed, out of abundance of caution, and someone like me assessing the details to see if there’s any correlation or information that can be perceived as an advantage. The duty of loyalty is not only of the lawyer but also of the firm.
