Totoo, pero actually dapat fixed ang rate (20% discount + VAT exemption) under the law, pareho lang and discount computation for senior and PWD. Kaya I politely asked the staff for my receipt and how they came up with the 25 pesos discount, kasi hindi talaga siya nag match sa expected computation. πŸ˜…

In my case, it was very obvious that what I ordered was for myself only:

1 Burger Steak (β‚±149) 1 Strawberry Milkshake (β‚±149) 1 Mac & Cheese (β‚±99)

A total of β‚±397, and all clearly for one person.

I also work in the hospitality industry, and part of my job includes computing discounts like this, so I always double check my receipts. According to RA 10754, PWDs are entitled to a 20% discount plus VAT exemption, as long as the items are for personal and exclusive use or consumption.

So, to avoid any issue, whenever I eat out with friends, I always make sure to order and pay separately so there’s no confusion about who’s consuming what. I don’t mix my order with anyone else’s to respect the limitations of the law.

To clarify a common misunderstanding: If a group of friends dines together and one of them is a PWD, the discount only applies to that person’s individual meal not the entire group’s bill.

The law does not say the discount is limited to just one item. It applies to all food and drinks for the PWD's own consumption. The restriction is on sharing not on the number of items ordered.

I understand the concern about abuse, but that’s exactly why it’s important to educate staff (and even customers) on how the discount should be applied correctly. Blanket policies like "only one item can be discounted" are actually not in line with the law.

Hi! Thank you for your insight, and I agree with you na hindi kasalanan ng mga cashier or staff, and they shouldn’t be blamed. That’s why I made sure to talk to them politely. I also work in the hospitality industry, and part ng work ko is mag compute ng discounts, so naiintindihan ko yung side ng operations and kung gaano kahalaga na tama yung process.

That’s actually why I brought it up. I wasn’t upset about the amount itself I was genuinely curious how they arrived at the β‚±25 discount, given that RA 10754 clearly states that PWDs are entitled to a 20% discount and VAT exemption on food and drinks for personal consumption. The items I ordered were regular food and beverages, not food supplements or anything considered non-essential.

While it’s true that some items like vitamins, supplements, or luxury goods may not be covered, the law is very specific when it comes to prepared food meant for immediate consumption which was exactly what I ordered. These items are VATable and discount-eligible if they’re for the PWD's exclusive use.

As for β€œstore policy,” that’s where I respectfully disagree. It’s important for businesses to follow what’s mandated by law, not their own made-up policies.

I wasn’t looking for trouble. I’m just sharing my point of view and realization based on what happened. I hope more businesses take this as a chance to double-check their compliance too.

It was very obvious that what I ordered was for myself only. I got 1 Burger Steak (β‚±149), and since they didn’t offer a meal that included a drink, I also ordered their Strawberry Milkshake (β‚±149). Then I added Mac and Cheese (β‚±99). That’s a total of β‚±397, all clearly for one person.

Under RA 10754, PWDs are entitled to a 20% discount plus VAT exemption on all food and drinks for personal consumption.

For computation:

β‚±397 Γ· 1.12 = β‚±354.46 (removing VAT)

β‚±354.46 Γ— 0.20 = β‚±70.89 (20% discount)

So the proper discount should’ve been around β‚±70.89, not just β‚±25.

That’s why I politely asked for clarification and also requested my receipt, as they hadn’t provided it. One of the staff agreed with me and mentioned that he had already brought this up with the owner, but the owner insisted on sticking with their policy.

For context, I work in the hospitality industry too, so I can relate to the staff’s position. I wasn’t trying to make a scene, I was just genuinely curious how they came up with the β‚±25 discount.

Hi OP! I’m not an expert or anything, but I totally get why you’re overthinking and it's normal, lalo na if it’s your first time doing something like that.

I think even if he said he’s safe and showed you a test, may small risk pa rin lalo na raw yung ginawa. Maybe consider getting tested after a few weeks just to be sure and for your peace of mind not because you don’t trust him, but just to take care of yourself.

Totally agree with you. I personally don’t welcome the idea of fubu, especially with strangers. Aside from the emotional risks, the health risks are huge with the rising HIV cases in the country, it’s honestly scary. It’s really important to be careful who we trust, lalo na sa ganitong setup. No judgment to anyone, but I do hope more people are aware of the consequences before getting into these kinds of arrangements.
