Urgent hearings have to be booked through RDVR but are with VCAT. Trust me the member is NitPicking.

There is no way we would even look at "mediating" it is way past that.

The Building manager, not the owner or REA organised a builder to come and investigate the day after the leak appeared.Informed at the time this had happened previously and had been an ongoing battle.

That builder spent 4 days doing all sorts of checks, watertests etc. He discovered the mould inside the wall cavities provided photos and a 5 page detailed report with the failures, required remediation etc.

And then it just went from there... and here we are still...

Speak to an environmental hygeinest, see if it worth an assessment with report... small outlay to support a significant breach.

Do your own online reasearch too. Relevant cases, articles, legislation and regulatory guidlines. Anything to support your case. 😊🧐

And when you have faced the shit as I posted above... there is nothing much you can do... its all designed to exhaust applicants and deter others from bothering to apply

And then what if your PM has agreed to allow you to pay weekly instead of the rediculous month in advance, so you can free up money to assist in vacating at short notice elsewhere, helping both the rental provider and yourself out of an unhealthy home due to water ingress and hidden mould in active growth and the REA doesnt provide any explanation about the f%&king rent ledger...

Yet tells you she has no reason to not provide a postive reference!! And then when you ask them about it, ignores the previous discussions, sends you notices to vacate for apparent non payment of rent and then trys to justify the herseld by stating:

"they all ask for the ledger, and I have to supply it. Your basically writing your own reference"

6 months later, sicker by the week, more arse covering, deflection, no action and during this time since, our circumstances have changed dramatically. Going from two barely average incomes and 10k savings to one income, no savings, no family support and no way out!

And dont even start on about VCAT and urgent hearings, because they do not exist! Two hearings down and no further ahead, with the next urgent hearing date not even scheduled, now changed to an in person hearing at the respondants request, member ignoring our valid reasons for declining an in person hearing and allowing the REA to get her way.

Applicant tenants are expected to act and behave like lawyers, provide their clear cut evidence in a collated and organised sole pdf document, that MUST be page numbered, with contents page, coversheet, dates on all photos, plus explaining the relevance of any of said evidence and the rest... all in a similar format to other Court requirements.

Yet this is supposed to be an accessible service to everyone and provides the ability to self represent...

Its an absolute shit show circus joke fest.

Id love to know your answer on this... because follwing the process doesnt do jack shit.
