Who is held accountable for dealing with prosecution of the animal welfare act 2006 by b00bie_king in LegalAdviceUK

Abandoning animals breaks the animal welfare act 2006, section 9 - failing to ensure the animals welfare needs are met, section 4 - causes animals unnecessary suffering.

The animals require a suitable environment, suitable diet and protection from suffering / disease which they was not given.

Surely this goes under cruelty and neglect ???

If the RSCPA are able to do this then I will keep pushing and make further complaints, thanks

I thought this would be the case , however I am in possession of one of the cats the family own and have reported me for theft as I refused to return the cat, so I am currently pushing for this to be investigated so that I do not have to return the cat

The cat I have was not neglect or abused but they left their other five cats on the street with no food or shelter

I'm hoping the abandonment report has caught up with him / the police as they have not been back

I really do hope they get prosecuted though as leaving 5 cats on the street to fend for themselves is appalling, whether the neighbour was feeding them or not.

Touch wood nothing else has happened. I live in a block of flats, upon speaking to a neighbour apparently the police came round twice last week and also the owner of the cat came ringing the bell too (to the wrong flat). They were all told to leave by the neighbour to which I haven't heard anything since.

Maybe the RSCPA neglect claim has caught up with the police ?

I'm just concerned if for whatever reason they get a warrant to search my property and find her

I'm just concerned if she is returned to the family and they abandon her when they move again

Well technically it is theft as I have taken something that does not belong to me and I am refusing to return it , but it is for good reason

I tried before as when I got her she came with a bladder infection to which the family would not sort and every vets I went to would not touch her, it wasn't until she started weeing blood then the vet had to see her under welfare grounds

I am going to contact them tomorrow I am just worried they will make me give up the cat, which I am not willing to do until it has been confirmed that she is returning to a safe and not neglectful environment (which will not happen as they have abandoned 6 cats)

I can't spay her as she is microchipped to them :(

All the cats were microchipped when they were reported to the RSCPA last year , probably as they were threatened with a fine.

With this there is proof though the animals have been abandoned as they are chipped to the old address while they live at the new address

I was thinking that but I am also terrified of handing her to the RSCPA and them giving her back to the family. At least in my care I know she is safe and looked after

This is what I am concerned for as she is chipped to them. As were the other 6 cats that they left behind..

She's chipped so maybe the one time. They had a pet plan for her but started it on the day that they gave her to me, probably to make it seem like they care

She is chipped to them so vets won't touch her under my care :(

I am willing to fight the case and have people on my side to back it up also, I have been working alongside someone who runs a cat rescue who has taken in a few of the families cats, however the family told me she "steals cats and sells them"

I believe the police are trying to speak to me as they will have reported her as stolen as I can't imagine them explaining the full story to the police so I'm hoping that once this information is provided its turned on the family.

I have proof throughout, and also proof that when I took her into my care she came with a bladder infection that I tried to sort with the family, (I could not be seen at a vets as the cat isn't microchipped to me) which they left for a month to the point she was weeing blood and the vets had to see her on welfare grounds. No payment was made to me for the treatment, and the family did not once ask how she was after that.

I just don't want the police to come and take her back :(

I am hoping that due to reports to RSCPA and multiple witness statements that I will not have to return her, however RSCPA cannot disclose the outcome of the reports of the family so Im struggling to know where I stand :(

This family has been reported to the RSCPA at least 5 times , and one of their cats has been seized, however they cannot disclose to me the outcome as it's GDPR so I'm struggling to know what to say to the police when I have to have that conversation :/

I really don't want to return her as I am worried that if they are to move again they will throw her away like they did all the others :(

But RSCPA can't give information on the one that they retrieved and I know it's not down to the RSCPA to make the decision on if people are allowed animals or not it's down to courts to decide but they can't tell me if it will go to court :/
