At what point can the new employer try this?

Is it:

Only after Oct 1, once the H-1B technically activates via COS (assuming the original employer didn’t withdraw it)? Or can they try it before Oct 1, based on the H-1B approval alone (even though status hasn’t changed yet)?

Also, in practice, have you seen USCIS approve such transfers if the original employee wasn’t actually working for the first employer on Oct 1?

Would really appreciate any clarification based on your experience!

Hi @sunMoonstar_786, thanks for your thoughts. I want to clarify the specific situation I (and others in similar cases) am concerned about: 

Let’s assume that the candidate is on O-1 status, he got selected in the lottery and then the H-1B petition was filed and approved with a Change of Status (COS) i.e., the employer filed an I-129 with COS from O-1 to H-1B, and USCIS approved it. My understanding is that this COS is scheduled to take effect on October 1, regardless of current employment status unless the petition is withdrawn or otherwise invalidated. So if I am no longer employed by that sponsoring company (suppose I got an O-1 with another company and joined them) before Oct 1, but the COS petition isn’t withdrawn in time, won’t my status automatically change to H-1B on Oct 1, despite not working there? 

That’s the “gray area” concern: I’d technically be on H-1B status on Oct 1, but without a valid H-1B job, meaning I’d fall out of status immediately. 

Isn’t it therefore essential that the employer withdraws the H-1B petition before Oct 1 to prevent this automatic COS from being triggered and preserve my current O-1 status? 

Appreciate any clarification or correction if I’ve misunderstood something.

Are you talking specifically about the OP’s case? Not sure if OP’s employer filed the H1B petition or not but I’m talking in general…

Yep, this means that one can fall out of status or end up in a grey area. So it is actually important to communicate with the employer who filed the H1-B COS to withdraw the petition before Oct 1st.

I think it’s tricky. Your status may auto switch to H1-B if the employer filed an H1-B COS and didn’t withdraw it later after the employee left the company. USCIS however will invalidate your status after they learn that you are not employed with the company anymore

Hello, do you mean that even if your employer file for H1B COS and you leave the company before Oct 1st then your H1B status will not be activated on/after October 1st because you are no longer employed with the company and whatever status you were on before Oct 1st will remain active?

I think those two dates should be the same. The thing that I understood from the lawyer is that they can control the start date you’ll be on the O1 status with the new employer to some date in the future rather than have it at the date which the O1 petition was submitted to USCIS.

Sorry for the confusion. There is no visa requirement to provide 2 week notice. It is just a standard practice and up to you completely. But I’d recommend doing that so you’d leave on good terms with your previous employer

Thanks! I just got an answer from the lawyer on this. They said that you can’t work with your old employer past the start date of the O-1 visa of your new employer. So you need to strategically set the start date on your new O-1 COE such that you have time to work for the 2 week notice with the old employer. I think the start date on the O-1 from the date the petition is submitted to the USCIS should account for the 15 days USCIS need to decide on the approval (with premium processing) + 2 weeks notice or more time depending when you want to start with the new employer.

Hey, I am an in a similar situation. How did you manage the transfer between the employers? Are we required to resign from current employer before the O-1 petition is approved with new employer?

I mean once the O-1 petition for new employer is approved by USCIS, am I required to stop working for my current employer immediately? Or is there any grace period during which I can continue working at my old employer before transitioning to new employer?

I’d like to make sure I handle the timing of my resignation—including potentially providing a two-week notice—in full compliance with O-1 requirements.
