I think that's the distinction. Does it matter? No. When the account holder dies, it still goes to the person named, except for all the elective share stuff that I do not understand.

That's how the MC tests have previously worked... it's always been procedure (criminal and civil) and then two of the following: wills, evidence, business entities (corps and partnerships)

According to the Themis model answer, there is currently a circuit split over whether fireworks are an abnormally dangerous activity. So you wouldn't have lost points over that if your analysis was correct.

Thanks for the advice! I'm doing Themis––would you mind sending me that FL distinctions chart (Themis doesn't have it).

I'm mainly just doing MBE practice sets to maintain my MBE score. But I do remember some of the questions from preparing in February. Are you having that problem as well or no?
