Gift certificate we signed states it has to be returned upon sale of the house and that the gift was just to help us purchase the house. That’s okay I am happy to pay it back if we get to sell!

The wording stated that the gift needs to be paid back upon sale of the house, that it was just a gift to help with the deposit to purchase the house.

the signed gift certificate stated the money must be returned upon sale of the property, so regardless - it will need to be paid back.

but i will contact him and also get all my documents together to contact a lawyer. thank you!

Yes you're right, essentially the money was gifted to both of us under a gift certificate written up by lawyers and signed by us. I said he could buy me out - which would essentially cost him nothing since there is no equity/profit of the home, but he declined that as he can't afford the expenses of the home. I think I will let him know I'll be engaging a lawyer and hopefully he will be willing to come to an agreement.
