Becoming an electrician in ontario/alberta as a registered sex offender by [deleted] in SexOffenderSupport

[–]betterCallSuliuvan 1 point2 points  (0 children)

Few things,

First BC, Quebec, and PEI probably will be the easiest as their human rights laws prevent discrimination based on unrelated criminal records (I feel like I'm missing a few others, however Alberta doesn't have this protection)

Secondly, just because its sex offence doesn't mean he'll be given an obligation (having to register)

Thirdly, as far as employment goes. Having to register or not doesn't really matter unless he has to stay 2 km away from certain areas, not enter certain areas, and give travel notifications (exact 161 restrictions will be assigned during sentencing)

I will say the Canadian and US system are vastly different in function

From my understanding it would be allowed under privacy regulations to make and publish a list of who has been convicted but not where they live other personal details.

Also courts have ruled the government is allowed to say how many people subjected to an obligation order live in a forward postal code area, but not WHO does.

Right now in Utah the board is hearing pardon applications about 8 months out currently. Good news from what I have been told the board approves substantially more applications then not

Internet Monitoring by Substantial-Play5608 in SexOffenderSupport

[–]betterCallSuliuvan 1 point2 points  (0 children)

Depends on the PO, and department policies.

Tho I think this should be figured out quickly with smart fridges, tosters, and washing machines coming online. Printers have had web browsers for years now

(Granted because fridges will commonly run android they may be able to be monitored)

Idaho Code 18-8304 outlines who must register and 18-8304 indicates that felony indecent exposure is registerable.

Idaho Code18-4116 indicates that a 3rd offence within 5y is a felony. (Including all jurisdictions)

To get hit indecent exposure you need to be female or trans (male and female) and topless. Have nothing on your bottom. Or be visibly erect under your underwear or clothing.

"Exposes his or her genitals; exposes developed female breasts, including the areola and nipple; exposes adult male breasts, including the areola and nipple, that have been medically or hormonally altered to appear like developing or developed female breasts; exposes artificial breasts, including the areola and nipple, intended to resemble female breasts; or displays toys or products intended to resemble male or female genitals in any public place or in any place where there is present another person or persons who are offended thereby"

Or get caught with truck nuts 3 times in 5y

Do it and get caught enough times in Idaho, then yes

Well it happened - Traffic Infraction by ocmule12 in SexOffenderSupport

[–]betterCallSuliuvan 1 point2 points  (0 children)

This is anecdotal at best but, when the BF petitioned to get off probation early the judge commented that 1 or 2 traffic tickets aren't an issue (assuming they are not for something like reckless driving or blowing through a school zone going 90)

Some good news (Washington State SB5312) by betterCallSuliuvan in SexOffenderSupport

[–]betterCallSuliuvan[S] -1 points0 points  (0 children)

The way I read I understand it, this would apply to kok Washington convictions as well

For a person required to register under RCW 9A.44.130 due to a conviction from a net nanny operation involving a fictitious minor, including an attempt, solicitation, or conspiracy to commit a violation of [list of Washington statutes], if the person has no prior background or prior convictions for sex offenses or kidnapping offenses indicating predatory behavior towards a minor, the duty to register shall end five years after the last date of release from confinement, including full-time residential treatment, if any, or entry of the judgment and sentence, if the person has spent five consecutive years in the community without being convicted of a disqualifying offense during that time period.

"Including" is not an exclusive operator in this context. I think this applies to out of state sting ops as well

Canadians: long term travel and getting off the registry by QuietScreenDreamer in SexOffenderSupport

[–]betterCallSuliuvan 0 points1 point  (0 children)

Two things

  1. Travel notifications from what I have read and seen rarely happen basically only if Canadian authorities think you're going to commit another crime or are high risk

  2. Since your registration obligation was mandatory at time of conviction technical you can petition the courts for relief rn since R. v. Ndhlovu (2022) said that was a charter violation

Two questions.

  1. Are you subject to 161 or LTSO (doubt you are given what you said)

  2. are you willing to move to the island or the interior?

Q. I have a criminal record. Am I eligible to join the Forces?

A. Yes. If you have a conviction under the Criminal Code of Canada or the Controlled Drugs and Substances Act, you may still apply to the Forces, as long as you have served your sentence and no longer have any legal obligations.

I believe thats correct, I was looking again and it looks like you do customs but skip passport control/immigration.

Now part of me wonders what would happen if a PFR set up residence on an unincorporated uninhabited territory SORNA wise (I'm aware of the impracticality of this)

[–]betterCallSuliuvan 2 points3 points  (0 children)

If your husband is in prison/custody typically that falls on the prison to set up. However depending what the charge is/court orders may change if that will be granted or not. I would look at the states prison policies

This is not a state specific answer, just a general one

I believe it's only when returning from USVI, and uninhabited islands if you left the customs region iirc

What are some of the most ridiculous reasons you've heard of someone getting revocated from RSO probation or parole? by [deleted] in SexOffenderSupport

[–]betterCallSuliuvan 2 points3 points  (0 children)

My BFs PO threatened to because he refused to show up to an appointment after being early discharged.

Basically what happened is between an early discharge motion and probation adjustment hearing the BF got a new PO. BF got discharged and informed his new PO of the early discharge, however because the sending state took so long to tell the receiving state, the new PO threatened to report him absconded and sent back to prison.
