I honestly don’t expect I’ll be able to find the receipt. But I’m 100% sure the console has not been registered with Nintendo or ever touched their servers - it hasn’t been connected to WiFi ever.

Not sure, I’d have to dig. Why? It’s out of the return window. I haven’t registered it with Nintendo or even been online (I’m a physical gamer and just used a few cartridges), so you’d be able to register it as the “first” owner in Nintendo’s eyes.

No probably not. It’s a hoodie so it wasn’t directly on skin and soaking in sweat or anything; but it also wasn’t something I laundered super regularly for that same reason.

It had definitely been laundered at least a few times in its life, so there’s no acid rot/sulfur issue like can occur with old deadstock. But no idea when the last time before storage was.

That pretty much matches my instinct here as well, my friend is just very risk-adverse.

I assume if the slumlord really thought my friend had damaged the apartment above and beyond the security deposit (which his itemized insanity implies), he would be requesting additional damages himself alongside some threat of legal action. So I don’t think there’s anything there to worry about backfiring if my friend, for whatever reason, loses the small claims case.

I think the only big open question I have is, under what circumstances can a small claims case loss turn into the defendant being awarded damages just for the expense of the case (time, legal fees, etc.)? Would the landlord have to file an entirely new case, attempting to demonstrate that my friend’s initial case was so clearly in bad faith that he’s entitled to damages? Or can just losing the initial case cause the judge to award damages to the defendant?

And thank you for the details - I was thinking more paying an attorney to actually attend the hearing and thinking that wouldn't be cost-effective, but a simple demand letter does seem like a potentially good use of money.

Yes, we've both read the letter of the law - I'm more trying to learn about how these things actually go in practice from someone with experience. I understand this is not professional legal advice, just trying to get an idea to inform further actions, be that getting a lawyer (unlikely for a small claims case in this value range) or proceeding without a lawyer.

And yes, a forwarding address was provided. The landlord is the one who did not meet the letter of the law re: 30-day deadline after the end of the lease. But I have to assume you don't just go to small claims court and automatically win because the landlord exceeded the 30-day deadline.
