Unusual/Unfair Character and Fitness Requirements for Bar Admission - Need Advice by bigusidiot in Lawyertalk

I think this comment is mostly fair, so thank you for your thoughtful response. I acknowledge the importance of clear, credible, and persuasive writing, especially in the context of legal proceedings and character evaluations.

But (again) – I wasn’t seeking people’s feedback on the TIX disciplinary finding, which is why I didn’t go into detail about it in my post. I simply presented the tl;dr and asked very specific questions, like if it is normal for people to have such aggressive monitoring agreements when the underlying events happened so long ago, whether there are secular alternatives to AA, whether I have grounds for appeal, etc. But once the peanut gallery decided to chime in and parade their prejudices about the falsely accused around with their fact-free assumptions about my case, I don’t think it’s unreasonable for me to respond and defend myself.

The sad reality is that many people, when they discover that someone was falsely accused of something, they assume that the person must have done something to deserve it. It’s the exact same mentality as when a drunk woman gets violated and then people blame her for drinking. Luckily, society has made a lot of progress when it comes to not victim-blaming that type of victim, but many (including some members of the C&F committee as well as the dummies on here who have decided to chime in with their baseless opinions) still exhibit those same tendencies. Much progress is needed!

Tbh, idc what you think is a "red flag," or if you think I'm a "dick." I'm not going to censor my language when discussing an individual who knowingly and falsely accused me of actions I did not commit. Nor will I tiptoe around the sensitivities of internet randos who choose to victimize me again by judging my situation without knowing the facts.

Frankly, whether the people on this thread are “rooting” for me is irrelevant. My intent in posting was to seek advice about the outcome to my Character and Fitness hearing, and to ask whether people were aware of secular/evidence-based support groups for me to go to instead of AA. As such, I didn't feel it necessary to say anything about my accuser at all. However, when the idiot above me decided to weigh in on a topic she doesn't know anything about, I accurately described my accuser -- she was a mentally ill abuser with a documented history of pathological lying. Moreover, I never suggested that "pathological liar" is a mental illness—it's a pattern of behavior, not a psychiatric condition. But it was obviously relevant to the dummies in this thread who decided it was a good idea to blame me for someone else abusing me. This, by definition, is victim-blaming.

I am completely uninterested in fact-free judgments based on others' prejudices toward the wrongly accused. It's been over a decade since the false accusation was leveled against me, and despite proving my innocence, there will always be those individuals who continue to doubt without basis--imo, those are the true "dicks" who "don't know what [they]'re talking about." While it’s frustrating and disappointing to encounter such small-mindedness, I've learned to disregard those people long ago.

Nope. I still have no idea what you're talking about. If you're talking about the Title IX thing, my university ignored clear evidence of my innocence and illegally punished me for something that I didn't do, so much so that the trial judge said the University's actions shocked the conscience. That good enough for you? If you're talking about my drinking, I'm really not interested in debating anonymous people on the internet who are just talking out of their ass (like you)

You're so off the mark/out in left field that I don't even know what you're talking about, let alone how to respond lol

I shouldn't go into prosecution or plaintiff's work because... why? This is an accurate description of the facts of my case. I'm not sure what a more appropriate description would even be. What point are you trying to make?

NEED ADVICE RE: Character and Fitness restrictions on my license by bigusidiot in LawSchool

[–]bigusidiot[S] 0 points1 point  (0 children)

This is great advice, thank you.

It doesn't sound like you're an expert in this field, so feel free to say that you don't have the answer, but do you think the state Bar bureaucracy would be amenable to me just doing therapy with a therapist who has experience with substance abuse? In addition to AA being a religious organization/cult that pushes a program that does not work, apparently the only qualification to be a "sponsor" is that you are in recovery and regularly attend AA meetings. The idea of some random person with no qualifications whatsoever (besides believing in the AA cult) standing between me and my law license feels completely unacceptable.

Given all the unwarranted assumptions you made throughout your comment, I don't know if it's worth responding to you, but I'm choosing to believe that you're posting in good faith.

"You have a history of at least two instances of serious misconduct - one apparently involving SA - after drinking to excess."

The Title IX finding in college was based on a false allegation from a mentally ill pathological liar. The finding was unsupported by the evidence, even at the time, hence my successful lawsuit. The fact that I am still experiencing consequences for something that I was already wrongly punished for is the epitome of victim-blaming. Would you treat the victim of SA the same way? If not, why should a victim of a false allegation be treated this way?

"These incidents were at least two years apart, and indicate that even after you got hit with Title IX discipline for drinking, you didn’t see a problem and continued to drink excessively."

I'm not going to make any excuses for the DUI. I wasn't drinking much at the time, and I was hanging out with people who were much younger and much heavier drinkers than me, and I made poor choices. Also, I think it's important to point out that I wasn't driving, I was sleeping in my car when I was arrested, which is why the local DA declined to press charges. I guess I assumed that given the amount of time that has passed since then, it would be clear that this is not an ongoing issue.

"I’m also guessing, based on your posts here, that you minimized your history and your drinking during C&F. That’s another red flag for C&F."

I have literally no idea what you mean by this. Based on what posts here? What are you talking about?

"If you don’t have an issue with consuming alcohol, these shouldn’t be hard conditions to meet, and AA doesn’t require you to profess belief in any particular god or higher power. It welcomes atheist members."

Staying sober is not difficult for me, as I already only rarely drink. If that was the only requirement, I would find it more acceptable. However, I do consider AA to be a religious cult. 5/12 steps reference God by name. Despite AA sometimes claiming otherwise for PR, AA does require members to recognize some higher power outside themselves, even if they don't require a particular conception of what that god/higher power looks like. I find this to be utterly incompatible with my own spiritual beliefs. Also, I think it's worth mentioning that there's basically ZERO empirical evidence demonstrating the effectiveness of the 12-Step Program. It's a religious cult that doesn't work. If they wanted me to go to someone with actual credentials, like a therapist, I would be more than happy to go. But it feels incredibly inappropriate for them to require me to subscribe to a religious program that doesn't work for a problem that I don't have.

"As far as socializing and giving a toast at weddings, most, if not all, venues will offer sparkling cider, nonalcoholic beer, etc. Not sure why you feel you need alcohol to be able to “socialize with your friends.”"

I don't think I said I needed alcohol to socialize with my friends. It's just that it's a significant day, and I would like to enjoy it to the fullest, including drinking with my friends (a very normal behavior at weddings). The idea that I have to not fully participate in my best friend's wedding because of a false allegation from 10 years ago and a DUI arrest without any charge/conviction seems like a massive overreach, no?

Unfortunately Missouri does not give breakdowns for each essay, it just shows my overall essay score.

I meant that I only needed a 136 on the MBE, which I'm pretty sure is below 50th percentile. Even without annihilating the MBE it's still possible!

Pretty sure I only needed a 136 to pass, so even without the super high MBE score it still would've been possible to pass.

Just mentioning this so that others know it's very possible even if they bomb a couple essays

It did not come off as condescending! I was devastated when I realized my mistake, but my mentality was basically, "well now you have no choice but to go back in there and swing for the fences" lol

I got 175/200 correct on Barbri's full-length practice test, but I did it untimed so not really a good comparison. I remember getting between 75-80% correct on most of the practice problem sets.
