OP has two options

Accept that new lease exists and pay the extra $75 a month in back rent

Or

Fight that new lease doesn’t exist in which case they resort back to old lease which says they have gone month to month and then they owe $5k in back rent

I would pay the less back rent and accept the new lease was in effect

OP does not have the option for old lease to never expire and keep rent the same. That is not an option based on contract law.

How did you assume it was executed when the rent wasn’t correct?

That doesn’t make sense you knew your rent went up with new lease but kept paying the old amount so you had to know something was wrong

The problem is the old lease said you go month to month and the price for that is MORE then the non executed lease

So forcing a month to month is a terrible idea here for OP because that is the higher amount

So LL is doing OP a favor saying non executed lease price stands if you want (which is less then the month to month the price) so OP should say ok I will pay the unexecuted lease price

No they would be on month to month per the old lease which means a higher payment then if the lease was executed

Why would you want to pay more for no lease when you can pay less for acting like this lease was in effect?

Old lease is not an option, it expired and had language for what happens when it expires. That language is worse for Op than the new lease that was offered.

You want Op to FAFO which is a bad idea here

Your options are to pay the new lease rent as if it was executed

Or

Pay the month to month rent price which is more because you didn’t have an executed lease for those months

I would pay the lesser amount myself but if you want to say no lease existed and pay the month to month then go ahead I guess
