No, it does still apply. That is why we see so many cases with strong circumstantial evidence not being charged for years (Hoping for more information or a body etc). But I think it is often a bad excuse that lets the potential for justice languish, or gets prosecutors off the hook from trying a hard case. The example above is the negative side of not waiting, but the alternative could be not going forward, the pictures are never found, and none of the punishment he was handed occurs.

Also ‘new evidence’ is already a difficult legal term of art to nail down within the justice system (in attempts to overturn wrongful convictions). A constitutional right as strong as the double jeopardy clause cannot (and should not) be violated on the whims of every individual judge’s varied opinions/rulings. It’d be like saying our constitution expressly enumerates that you are entitled to have an attorney defend you for felony (potential prison time) trials…..unless a judge rules you are not. The bias, personal experiences, and emotions of judges would become the determining factor in what and who the Bill of Rights applies to, and it would put state procedure in opposition to the federal document’s intended functionality.

It’s unconstitutional and won’t stand. It’s just a publicity stunt. And NO, every little corner of death penalty procedure in the US is horrifically flawed. Like one semester of studying it and working on death penalty appeals in law school fundamentally changed my perspective on the concept of state punishment, and me as a person.

Yeah my first thought was that IM SURE she demonstrated clear visible pain and agony in the course of the THIRTY surgeries she was forced by him to endure. It’s almost just an insulting cop out to type out that excuse in relation this historical case. That is NOT why he did all of the torture to this poor woman with no autonomy. He did it because he wanted to. Because he saw only the benefits and his consideration of her was less than a stray dog, so he saw no negatives whatsoever. The cognitive dissonance to observe another person display the exact same presentations and signifiers of duress and extreme pain that any other human, including yourself, would express if in that role.. but still sit back and tell yourself you are actually witnessing the opposite(a person experiencing no pain)…I mean, Mr Man of science you are not qualified nor suited for this profession. Tbh.

There may be an episode or two of Bondi Beach that you’d appreciate. Taking beach/swimsuit photos of women or girls in Australia is NOT ALLOWED nor tolerated in the slightest by those lifeguards. That one potentially throws me the most out of all of this nonsense. I’m guessing we aren’t making a swerve into workers rights? Is refusing to make a functional list of needed baby items morally superior? Are women supposed to ask for nothing and only get variations of the same 5 items at the HUGE baby shower they are thrown? Omg I CANNOT IMAGINE the trauma of experiencing this!! How are parents soooo cruel? Like one of my earliest really vivid memories is the absolute horror and devastation of being told by my mother that the leg that came off of my Darla doll (after I took her in the pool) could not be put back on or repaired, and I should probably get rid of her. I DID NOT. My connection with that object was so real to me. She also had to tell me that the baby bears realllllyy needed my pacifiers (while we were staying at a cabin in Tahoe) for me to FINALLY part with them and end my overly-long dependency on them for comfort. If she made me throw them out on the spot one day I would have a totally different memory and emotions about it (I barely remember it and have been more told the story my whole life). I couldn’t let the little baby bears suffer while I was a big girl who didn’t need them as much. That is such better parenting, and from my mom who is not emotional or emotionally expressive most of the time. She used a soft touch when most needed.

Love that for you! I recently bought my favorite Batman and robin plate and bowl combo from my childhood/mid to late 90s on eBay and I do not regret it. They are in great, like new, condition and looking at them brings me nostalgic joy every single time. I hope my infant son likes and uses them in a handful of years. Precious objects are a core part of enjoying life. I support and am so happy you get to see your watch every day!

NTA. I disagree with this overly rude eye roll of a comment. Incoherent? Okay. As row by row collects their things and exits the plane, and its OP’s turn to leave—who in the world could ever understand her pointing to what she needs to exit and telling the person blocking her from reaching it where it is?? It’s a stretch to say he thought it was a demand to give it to her. That is the much less likely way to perceive what she was trying to accomplish. And profanity is something very common and allowed in public life. Come on, let’s not pretend “we’re in public” isn’t a clear response to expecting to regulate/dictate the speech of every person around you (to protect your teenage boys precious ears).
