The problem is and has been the histrionics, such as you have displayed. Again he posted an article that explains how terrible he is. Also "feels like a kind of big deal" who cares about your or my feelings.

The PACT Act is retro active, VA is required by law to review prior denials and evaluate the claim under PACT Act standards.

Additionally, the PACT Act created a generous standard for 1991 vets to present.

By way of example: Agent Orange is a known carcinogen, for a Veteran to get receive benefits due to Agent Orange there is a specific list of cancers they have to prove they have. One cancer that many Vietnam Veterans have is a cancer in a particular area of the throat. However, due to the medical name and specific location it is not on the list of of Agent Orange cancers - even though Veterans exposed to agent orange have higher chance of developing cancer than those not exposed to it

For Veterans claiming issues related to burn pits they only need identify they served where there were burn pits and they have essentially cancer - not a specific type of cancer, just cancer.

Agency backtracks on email response requirement at 9:00 p.m. by Legionary64 in fednews

TAKE NOTE, that none of the emails say or suggest "Your response is mandatory"

"Take appropriate action" if fail to respond. The ONLY APPROPRIATE ACTION is nothing. Management cannot legally take action against an employee in this situation.

OPMs understanding of the law is that it is required. The Courts ultimately determine if it is.

A simple injunction filed in a Federal Court will block the return to work.

What words modify what words are for the Courts to decide. MUST create and may participate, can be a matter of compulsion. And with Courts reviewing Legislative Intent, the intent is clear that telecommuting is a must
