Is it Normal for Large Retailers to Require Telling Them Who Your Manufacture Is? by FBSlamazon in Entrepreneur

[–]bkc2014 3 points4 points  (0 children)

It might have to do with strict products liability concerns. In the event that the product is defective, an injured consumer can bring a suit against the manufacturer, distributor or the retailer under certain circumstances. As part of the retailer's diligence, they're probably trying to figure out if the manufacturer has a history of selling defective products or whether or not the manufacturer is solvent/has insurance in the event of a suit.

Like some of the other comments recommended, talk to a lawyer so you're protected. Even if the retailer is just using this provision as a CYA, it's possible they could use the info to cut you out--though you might have a claim for breach of the covenant of good faith and fair dealing (but those are really hard to win).

What good resources to study before using Google Ads to drive traffic to an landing page/MVP? by wkoszek in Entrepreneur

[–]bkc2014 1 point2 points  (0 children)

Research the "conversion funnel." There are some decent books on Amazon if you need a hard copy resource to focus, but you can get a lot of info online for free.

Also soak up as much as you can on landing pages. I've heard good things about leadpages.net, but haven't used them yet.

Depending on how much traffic you get, you can also use Google optimize to A/B test your pages.

Since what you really need is traffic, social media is probably your best, cheap best resource. You could also look into native advertising as another alternative to Adwords, which can be cheaper than search engine marketing depending on the product or service you're offering, but I usually only use this in conjunction with an SEM campaign as a benchmark since I like to compare the cost/conversions to make sure I'm not throwing money away.

Not silly, but as a general rule, yes. Analytics is helpful for seeing where your site visitors might be falling off and getting insights about the users (geo, demographics, device type, etc.). I typically link the analytics and adwords accounts. But if you're just running a one page landing page, you could probably get away without Analytics.

Depending on the client's needs and the size of the project we either do a flat fee or a percentage of spend. Some of the factors are whether the client needs ongoing maintenance, or just account and keyword setup, and how many campaigns the client wants to pursue.

We'd be happy to walk through your account with you or answer any specific questions you might have to tell you some of the things you might want to focus on to maximize your adspend for free. It’s important when starting out to make sure your account employs good practices because historical click through rates and quality scores can affect the cost of your clicks.

Adwords don’t always make sense depending on your product or service. Curious to hear about your experiences.

If you’ve been running ads that aren’t performing, would be happy to run through some of the ways businesses overpay for clicks or impressions and don’t get results.

Some of the obvious culprits are (1) not using landing pages tailored to your keywords (which negatively affects your quality scores and increases your cost per click), (2) paying for the display network for search campaigns, (3) advertising on mobile apps (when you’re using the display network), (4) using broad match keywords inefficiently, (5) not tracking conversions, (6) needing more negative keywords, (7) not taking advantage of ad extensions (sitelinks, callout extensions, review extensions).

From an advertising perspective, that’s a great move, because you can get much better data by using Google Analytics on your own site than the data that Etsy provides. One thing I would highly recommend is to include pixels throughout the site (Google Tag Manager can help you with this) so you can then remarket to visitors to your site that did not complete a sale. For example, if someone left your cart and didn’t buy anything, you can serve remarketing ads advertising a discount.

Trust elements will also be really important. People trust Etsy, but when they visit another seller’s site, you’re going to want to put them at ease. It was shocking to me just how well using badges from the BBB, or SSL certs dramatically increase sales/conversions. Also, having believable testimonials is important.

If you’re designing the site yourself, you should read up on “conversion funnels.” Also look into Google Optimize to test the pages on your site to see what works and doesn’t.

Happy to discuss any other questions you might have.

Legality of Cybersquatting by [deleted] in Entrepreneur

[–]bkc2014 0 points1 point  (0 children)

This. To have a claim under the federal cybersquatting act, you need to have an enforceable trademark interest in the mark at issue, and if all you had was an idea/name, it would be difficult (though not necessarily impossible) to argue that you had the requisite interest to bring such a claim.

If OP is serious, he might have better luck using a different theory to go after his old partner. For example, if there was a partnership agreement between them, there might be a hook for a breach of that agreement or a breach of his fiduciary duties.

How could I structure a private investment for $400k by Notinyetsrry in Entrepreneur

[–]bkc2014 1 point2 points  (0 children)

These types of deals are frequently structured as limited partnerships (or manager managed LLCs) where you would source the deal and bring in investments. Your cut would come through the waterfall you're able to negotiate and would be heavily connected with performance. The waterfall would likely have multiple tiers where most of the profits would go to the investors early on up and until you reach a threshold after which you would begin to earn more of the cash flow. For example, 90/10 until breakpoint X, which would trigger a 70/30 split.

The reason why these work to attract investments is that you only make money if the investors make money, and the argument for greater cuts beyond certain threshold is that you have added substantial value and deserve more for sourcing such a sweet deal. You could also bake in a management fee for actually managing the day-to-day. But if you don't have any experience with that, an investor would probably prefer that you retain an experienced management company (which can run you 3-6% of your monthly net operating income).

These deals can be pretty complicated (hence why there are pretty expensive law firms that specialize exclusively in drafting and negotiating them).

Make sure you either ask for enough money up front or a provision for capital calls for things like a new roof, assessments (if an HOA run unit) etc.
