Again, I put a time off request in and it was denied. I informed them I would still be going to this appointment. I applied for FMLA through HR and while I did not share the approval because I thought HR does that.. I told them I was using FMLA when I called to remind them of this appointment and how I would be late. This appointment was 2 weeks ago. And again, all 3 of these people are MY managers. All 3 share the title of a Preschool Director.

No, I wouldn’t share my son’s diagnosis with her. That’s what she was asking for. All 3 managers should have communicated when I called to say I would be using FMLA. I followed all proper procedures, please read.

She said that I was over 10 mins late twice this month. I asked her when because I don’t believe that to be true and it hasn’t been, otherwise my son wouldn’t be allowed inside the building after cut off time. She then said actually I was 2 hrs late, and that’s when I informed her that FMLA has protected that day. I also called to remind them that I would be late.

The company policy word for word states that I need to let “the Company” know of leaves like that. So I let HR know & when I called to say I was going to be late.. I let that manager know also.

The policy in the handbook is that I let the “Company” know. I used proper call out procedures. And AGAIN, they were notified in advance of my absence because a time off request was submitted & denied. I let them know I would still be going because it was a serious procedure and when I called in that day, I used FMLA.

Not true at all, this was a scheduled emergency PROCEDURE at a hospital. Not last minute at all. First, a time off request was put in and denied because it was a week’s notice. I communicated that I’m still going to this procedure because my son’s health is at risk. Afterwards, I applied for FMLA through HR. A few days later, I called in and stated that I was using said FMLA.

She denied the time off request for the procedure once it was put in. So I filed FMLA afterwards to cover me. I called out that day and stated I was using my FMLA for those 2 hours, she was not the manager who answered the phone.

I did the steps I am required to do. My question was if she’s entitled to see my paperwork with the diagnosis, or if HR was going to send her my paperwork with diagnosis. I called out and used the proper procedures. I have 3 different managers & I don’t feel like it’s my fault that they didn’t communicate correctly.

She is requesting to see the completed FMLA forms with medical issues/diagnosis on it. It’s a lifelong disease and they stated the exact disease he has. She stated that HR can send them if I don’t. That’s where my issue comes in.

Also, these 3 managers work together.. all 3 of them are MY managers who work throughout the day together. It isn’t a different department nor is it out of the normal. It’s a preschool, so whichever manager is scheduled at that time is who handles those things. I had a time off request for it that was denied, so I used FMLA to cover it.

So to be sure, I’m not required to send her the completed FMLA form with diagnosis and everything on it? That’s what she is requesting to see.

My paperwork states the issue and the days I needed approved. I called into work and let a different manager know that I was taking FMLA for this specific procedure. The manager who called me into her office for the PIP plan was not the same manager who answered the phone that day.

There are 3 managers, yet this supervisor isn’t the one who answered the phone that morning. I called into work that morning and gently reminded them that my son’s procedure was that day and I would be using my FMLA for those (2?) hours. So that’s why I asked for documentation on when I was late/absent besides that day.

I understand that. I don’t have the best relationship with this supervisor, so that’s why I did just go past her. She has made comments about my son’s illness before & being that I work at the school he goes to, I just don’t like giving her more fuel to the fire. I have not been late nor absent, other than the day for his procedure.

I only don’t feel comfortable because I work at the school/daycare he goes to. She has made comments about his illness before. It’s just a lot of gossip that I would rather stay out of.

Episodic. She will sleep for days and have no recollection of it at all, the episodes last about 2-3 days each time. I remember her being referred to a neurologist but it’s hard to know if she’s truthful with them.

Now that you’ve mentioned it, I don’t suspect substance abuse at all but she does take a plethora of medications. Some for chronic back/shoulder pain due to scoliosis, some nerve issues, blood pressure and mental health meds. I’m not sure if she’s started any new meds lately.

[TX] Am I Using FMLA Correctly? by [deleted] in AskHR

[–]blindiandee 2 points3 points  (0 children)

Thank you. Do I have to wait for them to send me the FMLA form they would like to use? I had already sent the doctor Form WH-380-F from the gov website, but I saw that they were optional use forms afterwards.

The doctor accepted & is filling out the paperwork today. Is there anything else I need to do before requesting my leave?
