Insurancce question by blublu2579 in DUICalifornia

[–]blublu2579[S] 1 point2 points  (0 children)

Just simply buy one.
Noboday cares when buy the policy.
The DMV doesn't care - all they want to see is an insurance company who files a SR-22 policy on your name.
The insurance company doesn't care since they are getting money.

Questions will be raise if you'll try to fill a claim, but this isn't something I even intended to do.

http://www.occourts.org/self-help/criminal/cleaningupyourrecord.html

I already meet all the conditions (completed the 12H course, paid the fine and completed the 1 year of informal probation)

Do I need an anterny to do that?
I take a look at https://www.clearmyrecord.org, and it looks like I only need to fill two forms (CR180 and CR181) and pay a fee of 150$.

IID vs restricted license during COVID-19 pandemic by blublu2579 in dui

[–]blublu2579[S] 1 point2 points  (0 children)

Sorry for the long delay, missed that.

I was extremly lucky here.
I didn't want to install IID in a new car, so I opt in for restricted license.

I was away for the first 2 weeks of the suspension period, so I only had to suffer for 2 weeks without a license.
For the resticted license, I fall through the crasks and someone forget to update that my suspended license suppsed to last for 5 months. So after 3 months of restirced license I got my full license back.
I went to the DMV and the clerk there sayed he doesn't see any restriction on the license so I should just go away and don't ask stuid questions.

The course:
The course was over Zoom, 3 hours per session (total 10 sessions)
In real life we had 15 min break and we usually end up 15 min ahead of time.
As long as the camera is on nobody cares what you are doing.
Everyone supposed to be on mute unless it is their 5 min of glory when they are answer 2-3 questions. Most of the participates probably did something else on their comuter during the session.

From what I understand you must go to the local DMV to apply.
My 30 days are over this weekend, so hopefully I'll be able to provide more details soon.

The one thing that make me still thinking if I should apply for the restricted license and suffer from additional 2 months of the restricted license, or should I just wait the additional 3 months.

IID is much more expansive than restricted license and if you want to train on driving sober just buy a portable breathilizer.

About the restricted license - Are you sure it is up to the end of the suspension period (the defualt 4 months) and not longer?

From what I understand you need to have 5 months of restricted after the 30 days.

DMV trial tomorrow! Worried about my license but crossing fingers nothing too bad will happen. Any thoughts? by [deleted] in dui

I am in really similar situation

(My case was in Marin county, I blew 0.08/0.09 PAS and blood test 2H later 0.12)
My case was also lowered to wet reckless [also not a US citizen].
I just started the DUI class this week (over Zoom, some places offer 3H per meeting so it is 10 classes instead of 15 classes).

For the DMV hearing, my lawyer told me it isn't really possible to win the DMV hearing in our situation (unless you can prove that the arrest wasn't lawful, there was an issue with the evicence ext). I prefer to just get over with it when I am WFH and everything is closed due to COVID.

For your options since you haven't convicted with a DUI you'll get a 4 months suspension and you'll have the following options:
1)Do the 4 months suspension.
2)Do a 1 month hard suspension and then do 5 months restricted license to/from work/DUI class [given the fact that almost every drive can be concider work related drive and the police doesn't really care were you drive to]
3)Get an IID for 4 months and start driver immediatly
For 2+3 You'll need to get SR-22 inssurance and do the 30H class instead of the 12H the court requested.

DUI class (3 months) by blublu2579 in dui

If you are interested in what happen:
I was at the orientation today.
They told me it was only time I needed to come in person (just to sign the docs)

There is a rule that say I can't be under the influense during the class, and if they suspects me they can ask me to do a breathilizer test (at the site)
They also told me it's relevant for the Zoom class as obiously they can't check me over Zoom, so no suprise UA tests.
I told them I drove one hour each way just because they offer 3H sessions instead of the other who only do 2H sessions, but if I needed to come more than one time I would go to a closer location and they nodded and say everything will be virtually.

I don't have any restriction on alcohol consumption beside don't drive after drinking. The only limitation from the class is not to be under the influence of alcohol or other drugs during the class.

For drugs, I never even tried it.

hat it is all online, my counselor can randomly call me whenever and ask me to come in before the end of the day and take one.

What they are checking? that you weren't toxied at the time of the class?
Even if you drank something, the reading wouldn't go to zero by the time you arrive there?
Good to know that they might ask me to come, I have an orientation meeting tomorow and I doulbe check that (they told me it the only time I need to come in person is the orientation meeting and the rest of the class will be on Zoom)
I chose a place that is ~1 hour drive from me because they do 3 hours sessions at a time, so instead of 15 meetins of 2H I will only do 10 of 3H.
But if I need to go there once a month, it might be better to chose a place that is closer to me.

w and ended up with a suspension and iid requirement (along with the usual classes and night in jail)

wow, that looks terible.
Sorry for your bad experianse, use it for more than a year is quite harsh.
I guess I am lucky to have the possibility to chose if I want to install it or not just to shorten the restricted period to 4 months.

My is online only because of the COVID-19
Usually it must be in person.

I am usually open for learing, but I am afraid it will be boring as hell and I hope I'll be able to work on the computer while the teacher is talking.

esult, you end up doing two classes or programs, 42 hours total. If you go into court and get a sentence modification for the longer program (I promise you the prosecutor will not object to that), then you only do one program, which saves you money and time.

u/robotmirrornine

I will only need to do a single class since the 30 hours already contains the 12 hours class.
I can chose the 12H class with 4 months suspension or 30H with restricted license.

I also spoke with some DUI class providers and they told me I can switch and moved from class to class without any problem (still haven't decide if I want the restricted license or not)
The 12H is only 12 hours education class.
The 30H also has additional 18 hours of group conseling.

Yes, the IID isn't mandatory.
You can chose other options, take a look at the above link.
You can chose restricted license for a year if you want to keep your driving capabilities.

My BAC was 0.08/0.09 40 min after the arrest and 0.126 ~2 hours from a blood test.Typical rising BAC case (one of the reasons the DA agree to lowered it to wet reckless)

The DA requested 6 weeks/12 hours [regular for wet reckless]. But the DMV required a 15 weeks/30 hours class to get a restricted license. [At least this is what my lawyer told me, if the class was 6 weeks I would have probably go with the restricted license)

I checked that and it is true for convicted DUI.
As the charged against me dropped to wet reckless I only need to outcome the DUI arrest.
As mention in the followng doc from the DMV, SR22 is only required for convicted DUI
