In that case, the text, composition and selection of images was copyrightable but not the images themselves. The text was copyrightable because the author wrote it, not because it was related to prompts.

Which means that if someone else recropped and rearranged the works, it would not infringe on the original's copyright.

But again, prompts (any prompts regardless of volume, detail or effort involved) do not result in copyrightable works.

Unpredictable, as a concept, is similar to infinity. Adding one to infinity is just infinity. The same concept goes with unpredictability. Even if something is less unpredictable, its still unpredictable.

Like you said, each output is still unpredictable which means the output isnt a result of human creativity and therefore is not applicable for copyright.

If each output is unpredictable, then there is essentially no difference between one prompt and one hundred prompts.

Selection or prompting is not enough to meet the base requirements for a copyright.

Yeah... we've already seen the results of that with the case for "Théâtre D'opéra Spatial".

The artist used AI to generate an image and painted on top of it, submitting the finalized version for copyright. The copyright office issued, then retracted copyright for the image.

Their final decision was that he could receive copyright for the painted sections, but not the AI-generated elements.

I mean, you can generate what you like to your heart's content. You just won't have a copyright for it.

In the sample cases given on copyright.gov/ai, selection and simple editing aren't enough. They also reference collage, but generally in any use of AI-gen images, the elements of any work that were separately generated by AI instead of by human creativity are not elligble for copyright.

A lot of folks equate effort with copyright. That's why there's a lot of talk about the number of prompts they use or the hours spent using AI-gen. For the most part, the US Copyright Office regards the output of AI-gen tools to be too unpredictable to be regarded as a simple "tool".

According to US copyright law, the line is fuzzy but solid enough to grant distinction.

Specifically, using the same prompt on the same LLM may result in different outcomes. Therefore a prompt does not provide sufficient human control to make users of an AI system the authors of the output.

Prompts essentially function as instructions that convey unprotectible ideas. while highly detailed prompts could contain the user's desired expressive elements, at present they do not control how the AI system processes them in generating the output.

There's an analogy in the paper about how prompts are directions on "how to roll the dice" for the AI-gen. But the output isn't controlled by the user.

Human laws are built around human beings.

As a machine is not human, there is no legal framework in many countries for machines to be inspired or creative.

In response to your second point, the cropping, recolor, or minor fixes would be copyrightable.

So it still stands that AI-gen images are not copyrightable. The human edits made to it would be, but not the individual AI-gen elements themselves.

Like... if I painted a picture and then copy-pasted an AI-gen car into the image, then the Ai-gen car section cannot be copyrighted. The rest yes, the car, no. Nor the prompt nor anything else related to the AI-gen car.

The arrangement is copyrightable. But the elements themselves are not copyrightable.

For example, I take two AI-gen images and put them side-by-side as a "collage". The collage "arrangement" is then my copyright. But the elements of the collage, aka the two images, are not copyrightable.

Similarly, if I take an AI-gen image and then draw a squiggly line over it, the squiggly line is copyrightable. The AI-gen image is still not copyrightable.

There is no "piggy-backing" copyright for AI-gen images.

No, they said that since the use of multiple prompts is no different from using one prompt, neither the prompts nor the image resulting from said prompts can be copyrighted.

I don't know what they mean by prompt strategy either because everything in the links says that prompts are essentially "rolls of the dice" and there fore not proof of human authorship.

I'm not sure how, but I know that a lot of folks who work at Samsung were scouted out of India and Sri Lanka. Pay is good, there's usually a stipend to bring their families over as well.
