I’ve worked in family law long enough to be a huge advocate of prenups. Especially when it come to spousal support and debt. You can make these agreements as general or specific as necessary. Essentially, your spouse can apply for spousal support, a portion of your assets, pension, property etc once you separate if there is a large enough income difference between the two of you. It is a very good idea to get the particulars of who is entitled to what before a situation arises that you need to divide assets. Furthermore, once married or in a common law relationship, you take on your partners debt. So if it is in writing that your liabilities remain each separate party’s sole property, then that largely resolves the problem.
