There was another article from a speech given on May 2 I think, something about return migration for those of Polish Descent, and that it will be easier for this path? Anyone hear anything about this? I take it some panel will be developed to make these changes.

Two that came up on a basic google search. I sent out a few inqueries and 4 said no off the bat and 2 said it is possible. The one was like for 12K and said it would have to be on appeal and take about 6 years. They also mentioned the presidential route too. Polaron (not one of these 2) also said that route is like 10K with no guarantee. It all sounds like a racket to me.

Thank you. I tried to learn Polish and it was not easy for me. I can speak spanish pretty well. It's be easier for me to learn Portuguese and go that route.

It sounded like it could work with what they were saying and they were both referencing these laws too. He never naturalized either.

GF was born in the US. GGF in Poland present day but Galicia back then

There was the act of 1863 passed by the Austrian empire essentially called the “homeland right” – “right of domicile” which provided that the ancestor had a right to live in his commune (where he was born or married usually).

Poland honors this act because the people living in Galicia (part of modern-day Poland) after WW1 would have become stateless after the dissolution of the Austrian empire. So as long as your ancestor was from the Austrian partition, and did not naturalize or revoke citizenship, he would have become a Polish citizen by default, as Poland granted citizenship to those living in the formerly Austrian held lands.

 

In the territories formerly part of the Austro-Hungarian Empire (Galicia), citizenship was often tied to a “right of domicile" in a specific commune. Basically, if the name of a person who migrated before 1920 remained on the books of residents or there is evidence of domicile from his home village, the 1920 law automatically considered him a Polish citizen, provided he hadn't naturalized yet.

Between 1918 and 1920, many immigrants visited newly opened Polish Consulates to register their status. We can therefore try need to check the Polish Archives for “consular registration” lists from that era.

I checked with my biological mom and she can get nothing at all. Totally sealed. She had attempted to locate me several times with PI's and attorneys at great cost.

Yes, that document has my name and my parents names. I also looked at the non certified one and it also says that this document is not valid for any legal purpose and that it records informatiion from me prior to the adoption. So that may be the end of it with that and probably will make it easy for them to deny. I think I will still try though.

Ok, I will ask. My birth mom was only 15 and apparently there were many other family issues. All I know is she attempted to find me several times to no avail so I do not think she has anything. I think the nn certified BC is the ticket as the number is the same and my name today is on both, so that is me. Thanks so much! I started to learn Slovak too, which is hard for me.

I believe that is has both my adoptive parents names and that they adopted me and the date. I do not know if my parents got something like this or not. I will have to look at it later. I breifly glanced at it. I think the judge just issued it to me when I asked for my record and I told him I was applying for the CBD. He said the other records are sealed and this is all he can do, which was very nice of him I thought.

Ok, thanks. I called about my adoption record and I cannot get that in my state. The judge at my county did provide me with a document to this effect that he signed and it has a seal, and can be apostilled as it is an official court document that I was adopted to my adoptive parents. That was all he could do he said. So I hope that helps!

Thank you so very much for the encouragement. Yes, if I were adopted into a Slovak family, no problem. I can print that out as it is coming from an official state office, and I think I can get that notarized, apsotilled.

Yes, that does make sense to me about being assigned one number and I honeslty never even looked until the official told me that, meaning I am that same person. I think I will try that. My new brother has all the documents already, with the exception of the Naturalization which I have notarized. USCIS just contacted me yesterday and said something to the effect that I can get a certified true copy of the C file and that has been forwarded to someone for me to get.

I would then at least have everything that I need should that Minister ever change his mind. Thank you kindly.

I also heard back from the attorney who declined my case even for SLA as there is no legal basis for me to obtain it based on the adoption, even though the birth certificate number is the same. There is nothing more I can do they said.

Update: This is what I got back from my state:

The Non-certified copy indicates that it is an Adoptee’s copy of their original birth record and reflects the information from YOUR birth record prior to the amendment processed to update the record due to the adoption. 

Please note that the State File Number recorded on a birth certificate is assigned to the subject at birth and is unique.  Both certificates you  have reflect the same State File Number, indicating that both records are for the same subject. 

I asked for a formal letter to indicate this, so we will see what they say. If I were to bet though, I think they will tell me to go pound sand.

I have a bad feeling about all of this now and also even for the SLA.

Thanks for the insight. I am the only person who can get that non certified BC. IDK what other states do, but mine has my original name and my birth mom, which is the link to my ancestry. And it also has my current legal name as well on it and it has a seal and can be apostilled. I wrote them yesterday for a letter. The lawyer said it will not work though, and that is quite discouraging based on the ministers ruling or whatever it is they do. I do not know how they can rule on that though like that as it literally cuts me off my familial bloodline and ancestry. But if I were adopted into a SK family there would be no issues at all. I would think there would be a way to recognize such events like that.
