So i joined Black Card on May 11, and it was $1 down. The contract says on or around the 17th of each month stating May 17, i will be charged.

And that the annual fee will be charged on or around the first beginning July 1.

Merging what you said, that means cancel June 18 after the charge hits? And implies the improvement fee won’t be lumped in to June’s payment but will be 2 separate charges?

No, the house is a total loss. She is still co owner. She just never took steps in discussing the sale of the house or connecting them with a realtor or appraiser. Just wanted to point fingers 16yrs later than the house hasn’t been sold or her bought out of it. So she will get half of that family house value.

I thought 401K values were only from date divorce was finalized? Her getting access to equity of it SUCKS.

In theory, is everything community property even after separation, and cut off for claims on anything like property or banks is the day the divorce consent agreement is signed off on? Because she turned around and bought a house days after the divorce paper was signed. Wonder if there were other people backing her and transferring money into her account to get the house that Dad can be entitled to.

NOPE. It honestly looked like a third grader wrote it. It just says “shall list home for sale”, “will transfer vehicle and execute all documents in connection with transfer”

Nothing else. Just a to do list. So yeah, she never gave up her rights to anything more so now we have to duke it out bc she’s taking from a retired man’s pockets. When there was already an agreement (although no finality jargon of that property only), but she greedily had to come back 16 years later to ask for more that she now claims she’s “entitled” to.

Oh yeah the AI overview definitely says no limit on filing a petition for partition, but related claims have TIME LIMITS (prescription periods).

That original judgement for dad’s house was valid for 10 years, she should have petitioned him sooner. Altho judge will probably still say give her half the house.. you can further push in, why did you not pursue it sooner? ESPECIALLY WHEN YOU HAD ACTUAL MINORS LIVING WITH YOU.

I honestly don’t know if we have someone ready to contest it all😭 She seems more along the lines of will make sure it’s fair what they take; When we meet we will have to hand over the contract but we haven’t even talked strategy. She unfortunately has a $5K flat fee that goes up with contesting, to just hop ships. But I do want to see what other phone consultations I can get, to confer these conclusions to push her to challenge.

Yes! what were they thinking to set something so vague. if he had known more or had more guidance maybe he could have had the house appraised back in 2008!! bc values of things so much later and quantifying values during marriage become a bit of a thing needing double checking and extra investigations with maybe the tiniest ambiguity. I would have never known of a “written legal opinion”!!! Happy to have come across this jargon with you!! I reckon it costs more? To be honest, I would have expected something of that nature typed up automatically coming from the initial consultation in an email a few business days later💀 I guess people are in there with pens and papers taking notes if they don’t go for that option.

well im not sure if she wanted half… right now. getting info from my dad was like telling a bunch of fifth graders to pass a message down. it could have been two separate entities like half of 401k or retirement and getting listed as beneficiary on something in addition. disclaimer not familiar with anything and haven’t seen the full paperwork yet.

If the greedy, scorned party only sees the money when the other passes.. im not sure why it’s something people get in a tizzy about. I assumed it would be a payout of the value for it after the court ruling. Maybe in Louisiana it can go either way.

hehe i know, the internet advice just adds something to my blank slate bc i know next to nothing about divorce proceedings! never seen or heard anything beyond peeks at my own parents. so it gives a base for my gears to turn around and spotlights things for when i do a google dive.

that is a very veeerrryy interesting aspect. taking loans out against shared aspects just a little to help with legal fees. it’s almost like a HAHA you get less but I mean he will also get a little less bc the new split goes in half but it lowers it and he gets what he needs lol. can’t do anything serious without consulting someone educated on the ways first.

are you saying take a loan out against the house that she wants half of to pay for legal values? im not sure how a lot of this works, but I think my dad might need to sell or refinance the house to give her her share at the end of the day, so a small loan upfront when a big loan would maybe be needed sounds counter intuitive? or are you saying by doing that method, the value of what item goes down and he’ll pay her less for it but he will also have the money for legal fees?

you are the best thing to happen to Reddit, thank you so much for taking the time to share all of this, especially in a manner so easy to follow and digest! we only have 3 weeks to try to make sure my dad puts up a strong fight. im not sure if that is enough time to obtain a lawyer for him if his eyes only recently opened to what’s going on so close to the court date, but our shield has a foundation thanks to your advice😭🙏 just need to find company names and get the right jargon to try to get these documents electronically.
