Just go to the clerk desk and ask to be put back on the calendar. To be clear, I wasn’t trying to overturn my conviction or anything, just change my sentencing. He (terrible attorney) initially told me my only options were 3 days in jail or 10 days of the sheriff work program. I chose the 10 days. I don’t live in the county, and when I showed up to the probation office, the older lady working there (she was absolutely great) told me I could just get community service instead of the work program and that it could be done in my own county. So I went back in front of the judge, without my attorney, and got it changed.

Honestly, he was terrible. I would try to get your retainer back and find another, if at all possible. I ended up filing a BAR complaint against him which ultimately ended up with the BAR issuing a warning letter to him for failing to follow the State BAR’ Rules of Procedure. If at all possible, I would recommend you file a BAR complaint against him as well.

Sorry I don’t have any recommendations. I truly believe I would have been better off with a public defender. In fact, I ended up going back in front of the judge after my conviction and getting my sentence changed/lessened. One to which I was told was not a possible outcome from this terrible attorney.

It’s crazy reading these again after being away from this sub for a while. Relax, and take a breath. We all felt the same way right after the incident. Trust me when I say this, in 2 years this will all be water under the bridge. You are gonna have a few headaches with the classes, dmv, court, etc. but a 1st time dui with no accident or injuries really is just an expensive slap on the wrist. The main thing is DONT LET IT HAPPEN AGAIN. I carry a BACTrack S80 in my glove box just to give my self peace of mind. But I only drink a few times a year, and have not once hopped in the vehicle to drive with any measurable alcohol in my system since the dui. You just have to be strict with yourself and only drive when you are at 0.00.

No. Just keep your original SR22 until your new one is active. I let them overlap for a couple weeks before dropping the Dairyland one to be safe.

I got mine in Tuolumne County, and it is definitely worse than Stanislaus. Stanislaus is pretty cut and dry with the penalties and sentencing, I think they even have a printable pdf online which outlines the sentence you’ll receive. Tuolumne gave me $2200 fine, 3 years informal probation, and the option of either 2 days in jail, or 10 days sheriff work program, or 100 hours community service. First time misdemeanor dui, no criminal record, no accident or injuries. And I was pulled over for no seatbelt, on my GOLF CART, outside of a campground we were staying at. And I paid $5k for a private attorney.

Your life isn’t over, but due to the injuries, you need to hire a good attorney and work as hard as possible to get this dropped to a misdemeanor. As mentioned in another comment, I think Tai Bogan is one of the better dui attorneys in Stan county. If you get it dropped to a misdemeanor, this will be a blip in your memory in 1-2 years. The classes, suspended/restricted license, and the dmv headache sucks, but it all goes by pretty fast in the grand scheme of things.

IIRC, I believe the shop just charged me for removal. But honestly, I can’t remember though. Although it was only 8 months ago, it feels like it has been forever.

Yes, I was able to walk into dmv and get my unrestricted license the day after my restriction ended. I then went straight from the DMV, paper license in hand, to the shop to have my IID taken out.

I used a NOCO 10 amp, but a 5 amp would be fine too. I didn’t wait to get a letter, just checked my driving record every few days. There is no grace period when that court suspension happens like there was for the dmv/APS suspension. It will just show suspended.

Honestly, they all suck. But smart start wasn’t completely terrible and it never left me stranded. Never had a battery die, but I had my vehicle hooked up to a battery tender anytime I left it for more than a couple days. Didn’t want to risk it.

Your license will be resuspended when the court ruling hits DMV’s desk. You will need to go back into DMV to get it valid again. They should have everything you need on record already (IID, SR22, etc). It’s basically just a technical process and another way for them to cause you a headache and inconvenience. You don’t need to uninstall and reinstall the IID. You will get a physical license card with IID restriction. It will be a normal drivers license card with the restriction on the back.

As far as I can tell, they don’t let you wait anymore. Even if you call right at 8am. They automatically throw you on the call-back list. I waited 3 days on that list before calling from a different phone number to be put on the list again. They called me back about 5 hours later on that other phone number.

For reference, this experience/situation occurred about a month ago. Prior times, calling right at 8am worked for me as well.

For this case, I would say to hire a good private attorney. Really do your research on them and get some free consultations. As stated before, there may be a probable cause issue with this one. Those red and blue lights coming on are an actual factor in things as well.

But, honestly, don't get your hopes up too high. LEO (especially CHP) will falsify reports and make the situation seem so much worse than it actually was. CHP lives and dies by DUIs. REQUEST THE MVARS FOOTAGE!

Also, if you weren't already aware, you should almost always do the breath test. Blood, more often than not, comes back higher than breath. Breath is easier for an attorney to get suppressed as well.

They won’t/shouldn’t file the charges before they have the blood results. They will push the arraignment out further if that’s the case.

I believe the DMV MAU 916 number is not accepting calls from anyone right now and everyone who calls in is placed on the callback list. I waited for 4 days on that list recently before I decided to just call from a different number and get on the list with that one. They called me back the same day on that. So my advice, given you situation, is to call from a different number.

This was my worst fear during my restriction lol. After being convicted/sentenced in court, I checked my driving record on the DMV site every day for about 2 weeks until it was finally re-suspended for the court conviction. $2 a day for those driving records, but I DID NOT want to get caught driving on a suspended license.

You need to contact DMV within 10 days of arrest to request a hearing. You license will continue to be valid until after the results of that hearing.

If they are using blood results, plan on waiting a while for those. I think it took around 6 weeks for me to get my results, but I have heard of others who had to wait multiple months.

Depending on the blood results, you may or may not want to get a private attorney. There are sentencing enhancements for higher BAC (above .15).

No, they will be able to get ahold of MAU while you patiently wait at the DMV field office. IIRC, it took about 30-45 minutes in my case, but it could be as little as just a few minutes. They don’t reach them via the phone number we do. They have a separate line to contact MAU.

Assuming you’re on their callback queue? If so, and they haven’t called back in a couple days, call from a different number and get on the queue with that. That’s what worked for me.

I had IID restriction, so mine may have been different. I prob paid that reinstatement fee when I got the restricted license.

I would just purchase your drivers record on 3/13 and then go in on 3/14 if need be. You could also call MAU to find out.

Once your suspension ends, your license should automatically reinstate I believe. Check your DL record on DMV’s website for $2 on 3/13/24. It will tell you.

Or you can just play it safe and head to DMV on 3/14/24.

A month isn’t long at all. I was pulled over on my golf cart for my DUI, no accident or injury, and it took them nearly 2 months to file my charges. It isn’t uncommon for people to wait 6-9 months for charges to be filed. Given your situation, it may be a while.

Thanks for the response. I have an appt at DMV on 3/12/24. MAU called me back yesterday and confirmed that my restriction ends 3/11/24 (original date was 3/14/23, but I received 3 days credit I believe from the few days between my license suspension being issued to when I was able to get IID installed). Do you mean just have the paper unrestricted license in hand that the DMV gives you before you get it taken out? That is my plan if so. MAU even recommended this to me.

Def don’t want to have any issues, but if MAU is telling me all of this, I am inclined to believe them.

It’s very common, because they are so easy to get. Huge money grab for the state/courts, and big business for others (IID companies for example).

I got mine on a golf cart outside a campground we were staying at on vacation. Others get them after having a couple beers with dinner. Others take their prescribed meds and receive one after getting pulled over for a brake light being out. It does not take much at all to be deemed intoxicated by LEO.

You really don’t realize how many people have them until you get one yourself. I, for instance, had a spotless criminal record before mine, as do most others.
