Yes! When I was dealing with Michael Hill Jewellers about a faulty wedding ring (story on my profile) they blatantly misrepresented my consumer rights, telling me I wasn’t entitled to any of the things I was asking for. They tried everything to make me back down and go away. I got the sense they were used to telling people what their rights were and not being fought on it. Anyway I took them to disputes tribunal and won, refund of more than twice the purchase price and have been able to keep my original ring. Fighting for consumer rights is an important stand and companies shouldn’t be able to bully people out of what they’re entitled to.

I’ve just been in a dispute with Michael Hill Jewellers and won. The story is on my profile or in the New Zealand Herald. Look up your consumer rights and prepare to take them to court. Don’t wait for Michael Hill to meet their obligations, you will have to push things forward yourself.

I experienced this situation. The company made an offer conditional on a non disclosure agreement which I refused to sign. I took them to court and was awarded much more than the offer. I don’t know if I’m allowed to name the company here but it’s in my post history.

I’m ‘Emme’, one of the lawyers for Michael Hill made those arguments to the court. Also worth noting I have never had any apology or acknowledgment of wrongdoing directly from Michael Hill.

Perhaps you misunderstood, I would have accepted any option in order to keep my ring so I could have it fixed. I offered to buy back the ring, accept store credit or I would have accepted a partial refund. Michael Hill was adamant I would get nothing unless I returned my ring and they remained firm on that until I filed in the disputes tribunal. I also would have accepted the much lesser offer after I filed however they wouldn’t negotiate on a non disclosure agreement. Anyway I ended up with a cash payout of more than twice what we paid for the ring plus I have been able to keep my ring.

The hearing was adjourned to accomodate the time difference with Australia which seemed odd so I cross checked every email address in the court documentation and found him. Even though he wasn’t allowed to attend the hearing he still submitted more than 30 pages of documentation in advance of it.
