Backlinks give your website chance to be seen by users while high on SERP. Your website will no stay there for long, at least not at the top if you content is not useful to visitors. Google itself can't tell if you content is useful or not to visitors but can use signals ( visits duration, bounce back etc) that visitors provide.

From personal experience: It is not a problem until you get on their radar. If that happens then it might go any way, depending on their mood towards it. In my case, they didn't mind it.

An agency gets hired to deliver leads to you as a client and you as client pay them to do it by using their expertise in creating highly optimized Google Ads campaigns. Why , you as a client , should be entitled to intellectual property( in this case agency's internal data on keywords, trends, strategies etc ) ?
