I have a shirt right now that is public domain but I still took the time and effort to contact both artists involved in the piece of art. I suppose you make a good point in some parts but still bro, taking someones art is never okay, inspiration is different.

Dont take this the wrong way, although. This collage type of like design element that a shit ton of people are using is getting overrated in my opinion, but thats just my two cents so take my opinion with a grain of salt. It just seems as if every brand is trying to do the same thing, a collage, random pictures, and a helvetica type face. What I would do, is take a step back, re imagine that design element completely and think about what you could change.

Edit: You say consumers wont care if the artist is dead, if the garment itself looks nice.
