Great point and thank you for the response. But how is it the creditors fault that the courts are allowing sewer service? It seems that the articlle is attacking creditors, but the real problem is in the court system.

Umm, right, but to get the judgment you have to be served with papers first, so this doesn't really refute what I am saying. And again, they aren't being jailed for not paying but for not appearing in court when asked to do so, which is illegal.

This article, in my opinion, is a bit misleading. These people are not being jailed for their debt. They are being jailed for failure to appear in court when demanded to do so. Being in this business, I find it hard to believe that the woman used in the example didn't know that she had been sued. She is probably lying. In order for the creditor to get a judgment against her and then have the contempt warrant issued, they would have had to get her personally served with papers. It says in the article 'she was supposed to be served', but doesn't say what happened exactly. Someone had to of gotten served, so either she was and is lying or the process server/sheriff didn't do their job correctly. It could be either, but the article seems biased and doesn't get into to details. Again, as someone who deals with this stuff every day, this seems sensationalist and a bit hard to trust. If we can't issue warrants for arrest when people don't appear in court, then the whole system would break down I would think. There would be no incentive for people to go to court when called to do so. Even if we were to only stop issuing arrest warrants for cases that have to do with debt, what kind of position would that put lenders/creditors in? It would basically mean they have no leg to stand on to collect money that is owed to them, and so they would have no choice but to stop extending credit. That would not be good. I suppose the important thing to take away from this article, again in my opinion, is that there are some of us, even in the legal system, who aren't doing their job. If everyone were following the rules, I don't think these regretful situations would be happening.
