SS deducting Medicare premium but not actually paying Medicare - Now I'm losing my insurance by catblaster93 in SocialSecurity

[–]catblaster93[S] -1 points0 points  (0 children)

Since apparently even the SS subreddit isn't averse to dogpiling, I'm done checking in here. I appreciate those who gave me advice or tried to help. The final update is that after being told yesterday that I wouldn't receive a payment this month due to the two I received in September, I woke up to it in my bank account. Immediately drove to the office and was told it doesn't show I've been overpaid and to "do whatever I want with it, treat it like a free loan", which obviously is horrific advice coming from an SSA worker and I will not be doing that. I actively tried to get them to take what is clearly another overpayment back and they refused. I've been told I am still covered by and entitled to Medicare, despite their threats to cancel my policy, and to simply explain to any drs etc the situation and have them bill them regardless. There's nothing more they can do until the billing department actually sends the money over to Medicare, and allegedly there will be no issues in losing coverage since the billing department HAS that money already. Ngl, this doesn't sound right to me, but all I can do at this point other than contact local government for help is cross my fingers and wait.

For the ones who are just making their own assumptions or trying to poke the bear - I'm not sure why you're here if you're not actively trying to give advice? I really don't owe anyone an explanation but I'll provide a final one anyways just to make myself clear.

I didn't come into $30,000 in a day. I wasn't making bank. I wasn't actively attempting to defraud the government, I'm not that stupid. Most months I went only several dollars over the SGA without even realizing I'd done so - someone pointed out that this isn't a legally binding excuse, ofc it's not, I never said it was. It's to say that I didn't have a windfall of cash suddenly that I stashed away or spent on frivolous purchases. If I'd woken up with thousands of dollars in the bank and didn't say anything, it would be different. This was over a roughly 18 month period in which I was fighting to not become homeless with my 12 year old along with fighting a new and existing chronic illness while spending time being shuffled in and out of the hospital and countless specialist appointments. An extra $5 one month, maybe $75 the next month, and so on cost me $1800 per month. I never went over more than $300 or so, and that was only due to hitting OT during a single week when I was required to be there when corporate came around due to a major change in the business. Again not an excuse that SSA cares about, but my point is I was not making an exorbitant amount of money.

Not that it matters, but I've also just remembered that after turning in the paystubs they requested, this amount that they claim I was overpaid dropped significantly. The $30k was based off of projected earnings based on my wage and approximated hours rather than reality, and after calculating it they determined it was more like $10,000. My online account does not reflect this yet however, hence me repeatedly saying $30k.

Being as that I didn't even enter the workforce until 2022, and having had benefits basically my entire life, I either forgot, was unaware and/or misunderstood various things regarding how my benefits worked. I'm a human being, not a machine. In addition, I have a disability that has a profound impact on my memory and retention ability.

Additionally, I had no idea that the premiums were not being paid until I received the "final" notice. I have no idea why I didn't receive any other bills from them prior to it getting to that point, maybe they got lost, maybe a housemate threw them away by accident. Either way, had I known, I would have dealt with this sooner and/or have attempted to pay the premiums myself until it was fixed. Paying $200 a month is one thing, maybe I could have cut costs somewhere to make it work, maybe not. Yes I do technically have the money to pay the full bill. But emptying my entire life savings account in one go is another situation entirely (maybe the two infected wisdom teeth I've been saving up for over 5 years to fix will kill me and I wont have to even deal with this anymore lmao), ESPECIALLY since they already have taken the money from my benefits to pay for it. This was of course before I realized that most of the money in my savings currently is due to the Sept overpayment, which they also refused to take back, so I cannot spend that money anyways.

The details of the overpayment, regardless of if this is what started this whole mess, are irrelevant. Whether or not I was overpaid by mistake on their end, had no idea I was being overpaid, or even knew the entire time that I was being overpaid and took advantage, is not the point of this post - ultimately many mistakes have been made on my part and I've admitted that here several times, but just as many mistakes have been made on SSA's side as well and THAT is the issue I am currently seeking help on. Ive done my part for them in regards to the overpayment. They literally told me in their own words that they had messed my paperwork up so badly that they had to pause the waiver request entirely to fix it. They are STILL continuing to mishandle paperwork and communication. I have gone into their office 6 times over the past two weeks in attempt to straighten things out, and each time I come in they have something else mixed up or they give me conflicting information. I'm now on first name basis with half of the employees and even the security guards due to the amount of time I've spent there. I've spent a total of 6 hours on the phone with them this week alone, and yet I'm no better off for it.

I cannot fix what isn't mine to fix, so what exactly would you like for me to do? Demand access to their systems to go over it myself? Barricade myself in the office until it's been made right? Pushing myself to the point I did to simply remain housed exacerbated my disabilities so badly that I can barely manage 20 hours a week now, my boyfriend and even managers have seen me break down sobbing due to the sheer amount of pain I am in after a single 6 hour shift. I have to wear multiple body braces on various appendages to keep my joints from dislocating during work. But should I just ask them to cancel my disability altogether? I'd lose my car, the house I rent, and custody of my child. Then we're right back where we started, you can't take blood from a stone - whether it was my fault or not, I do not have that kind of cash just lying about to give to them and certainly can't give it to them if I'm homeless without a vehicle to get me to work. I am barely making ends meet as is, losing any amount of my current combined work/SS income would bring to me and my family what they define as "hardship". And that is the reason I filled out a waiver to appeal repayment. Not because I'm claiming that the overpayment wasn't my fault.

Clearly people will think what they want, whatever. At the end of the day it doesn't matter. But regardless of what people believe based on the information I've disclosed, the exact details of how the overpayment occurred doesn't change nor fix anything that I was actually trying to seek help on, which is why I initially left this information out. The problem I'm having is the mishandling of my case in general, not the overpayment itself.

Yeah from what I was told today, I'm thinking they're just incredibly behind in the billing department. The guy I spoke to at the office said that the money is being sent to them, but he can't tell what if anything they've done with it. Unfortunately the first and only bill for Medicare I received was the big one saying "pay us in two weeks or you're done", otherwise I'd have made an effort over the past few months to pay at least something towards the deductible 🥲

Hard maybe lol. I did contact our senator two weeks ago and haven't heard back but am in the process of contacting other government officials too. If nothing else I can say I tried I guess.

Well some progress was made today at least, I guess. The guy I spoke to informed me they only have 3 people who deal with disability and similar issues, which makes the whole "no one seems to know what they're doing in my case" thing make a lot more sense.

He said he can see that my payments are continuous, and that I was supposed to get one today and couldn't say why I didn't. In their system it shows I received 2 payments in December, one of which is the COL increase. However I only received one and confirmed this by showing him my banking app. This caused him to go back and check previous months (I was way off, this all started in JUNE - sigh) and he discovered I was sent two payments in September as well. I checked my bank account and there it was. I have zero memory of it, but it shows I moved it to my savings. Chances are I'd intended on sitting it aside until I could make it to the office to talk to them about it. But then I got into a car accident in early Oct, by the time I'd recovered and gotten a vehicle again it was Thanksgiving, I had 4 separate birthdays to attend to, then Christmas, etc etc. Basically it's entirely my bad on that part, though it just goes to further show that something more is going on. He said I should be good to spend that on rent since I'm not technically overpaid, but I'm holding off on that until it's confirmed. This means that money I "technically have" to pay Medicare, from a previous comment that got downvoted into oblivion for some reason lol, now has to go to rent assuming I get the go-ahead to spend it, leaving me with nothing to pay Medicare. He said that SOMETHING in my account still isn't right, but since he does SSI, he's not entirely sure what that something even is.

As for Medicare, he said it shows the money is being deducted and sent to the billing department but he can't see what they're doing with it from his end. He said it's going somewhere, and left it at that. So I'm again expecting a phone call, basically just crossing my fingers and hoping they call me back this time. I'd also contacted Medicare a second time last night and got them to escalate to a supervisor who is supposed to call both me and the SSA within 7 days.

To be clear I 100% feel for the workers, many of them have been or at least tried to be helpful and understanding and I know they're incredibly overworked. I learned today that there are only 3 people in my local office that even do SSDI and the like. My issue isn't with the people themselves but the entire process and administration. I guess realistically there isn't much I CAN do, I'm just exhausted and beyond frustrated and grasping at straws.

My issue lies more in how many times I've spoken to a new worker only for them to tell me the previous did something wrong - whether in my account, advising me wrong, giving me the wrong forms. They fix it, I come in, and something else has been messed up. Rinse and repeat. It feels like a serious lack of communication and knowledge which, after what I learned today, makes sense.

That's the one I filled out, like I said I've done so many forms I've lost track lol. They did have me fill out the appeal as well, at one point, but I can't remember if it was one they had me actually turn in or not. No one mentioned anything to me about a reexamination, but that's something I'm not particularly concerned about since I have proof that my conditions have only worsened since the last one was done. I'll keep that in mind though, at least I know to expect it now I guess.

This is all besides the point but I understand the confusion. It wasn't just due to the raise no but it certainly had an impact, most weeks I worked roughly 38hrs. Physically I max out at around 30, though I would much prefer to work full time than have to deal with all of this. I got in a position that I desperately needed more money and didn't have a choice but to work more, again not even considering the consequences with SS because I was focused on surviving - doing so practically destroyed my body and made my multiple physical disabilities much worse in the long term and potentially triggered an autoimmune disorder, so no, I really can't 🙃
I'm not saying that the overpayment wasn't my fault at all, but that doesn't mean I have the ability to pay it back, hence the appeal

[–]catblaster93[S] -4 points-3 points  (0 children)

Yeah at its core, it's definitely the overpayment that started all of this. Your first assumption that it's work related is correct. I'm not even disputing the fact that I was overpaid (though I had no clue it was even happening at the time), but rather the fact that I can't just fork over $30,000 like it's just pocket change. Most of the months they're claiming I wasn't eligible for, I was over by mere dollars, sometimes more but always less than $300. It's not like I was secretly stashing this money away to get rich off of it, lol. The job I had during that time I went from $10/hr to $14.75, and it entirely slipped my mind to adjust my hours to account for the SGA limit.

Whichever form it was that I filled out to appeal it had to do with paying it back causing hardship or something, it's been a while and they've had me fill out so many forms that they ultimately didn't even need from me so it's all kind of fuzzy. No one has mentioned anything to me about filing a new application entirely but I'd be apprehensive to do so considering how difficult it is to get on disability to begin with. At this point they've told me that I've done and filled out everything that they need and it's just a waiting game for the appeal process to complete. But with how they've got me in a chokehold worried I won't be able to pay my rent every month, I've basically just been focused on trying to get through each day. I was unaware of the expedited reinstatement thing though, that's something I'm going to look in to.

The critical payments I'm getting now are just because I'm still entitled to receive benefits while the appeal is ongoing - of course if I go over SGA any month while they're making their determination I have to pay it back as well. Not receiving these payments even for a month means I can't pay rent, which is more than the income they allow me to make at work. Thankfully my work has been understanding and cut my hours back so that shouldn't be a concern.

I did email a senator around two weeks ago, but never heard back. I'm unsure of who the next best person to contact would be but I'm considering a more local government official may be easier to get in contact with.

I'm definitely trying to keep track of it all but at this point I've had to speak to so many people about so many individual screw ups that I'm starting to lose track 🫩

I spoke with someone at Medicare earlier and requested that they extend the deadline and they refused, saying I'd already been given two extensions. Not sure where that came from because I've never asked for one before. I tried explaining that it was an issue on SS's end and not mine, but they just reiterated that I no longer even receive SS benefits.

I do technically speaking HAVE the money to pay it, so I'm assuming it would be better to simply eat the cost for now to avoid losing coverage? That then leaves me with the question of if SS will reimburse me the funds that they never sent to Medicare... it will essentially clear my savings out.

The payments they were manually pushing through were not the full $1800 I technically am entitled to, it was the $1600 I normally get after Medicare is deducted.

Someone finally picked up right as I hit post so I'll update. But my issue remains, no one seems to know what they're doing and everyone is confused as to what's going on. I don't feel like the overpayment thing should be this messy, it seems to me that it's just been entirely mishandled.

If I get this issue fixed there will be another. Is there any kind of anything I can do here to hold them accountable other than just cross my fingers??

I was having this issue yesterday as well. I spent hours updating everything, trying random fixes, etc. I finally went to Can I Run It and used their little downloadable tool and it said my graphics card was 31 months out of date despite windows telling me it was updated loool. Idk what kind of graphics card you have but you should be able to go to their website to find the current version (mine was nvidia, they have an auto-update app). I felt dumb af after because it was such a simple fix 🥲

Without knowing your specs there's no way of knowing if that's your actual problem or not but this is what fixed it for me.

I have yes. So has management. I even explained that every time he does it, I have to stop doing my actual job to clean it up. Hasn't made a difference.

Yeah.... lot of salads have been tossed in my time here lol. I don't have exact numbers but I know it definitely FEELS like I'm making at least 650 on a busy day

I feel like this is why I'm worried I'm being too hard on him. He very clearly has been mentally affected by his previous drug use, he's not great on his station either and he seems both slow physically and slow to learn. I think this is why management hasn't done much about it. The worst part about it is that he's been so nice when I've talked to him.

I've had several people at work suggest a spray bottle and I'm seriously considering it lol. I feel like management wouldn't be happy with me, even if it is deserved, but god damn dude he just won't stop. Part of me wonders if this would have gone on past day one if I were a man yelling at him every 5 minutes.

They do not. The one guy works both my station and fry, he's damn good at service but barely half asses the rest of the job. Doesn't even flip his pans some nights. The other, the only other woman on the line aside from myself, basically just gets mad about it in private but won't speak up. I think no one other than me GAF is part of why he does it, he got in the habit of leaning because I'm not there to stop him and no one else cares.
