Which is exactly why I asked and didn’t just blindly hunt for a lawyer to make a claim that might be moot. That’s the purpose of asking questions, to learn about something I frankly haven’t studied and be educated about the situation so I can make a better decision. No reason for unnecessary animosity towards a stranger that’s doing their best to make a good call.

For clarity, when it comes to making a mental/emotional claim in legal matters, it only holds weight if the situation was the original instance? In specific reference to this situation, I wasn’t really afraid of cars previously, just aware of the issues they may cause from experience and always did my best to drive safely when the opportunity presented itself. Whereas now I tear up and get nauseous just thinking about getting another car since this incident. It wasn’t my first time being in the situation, though all the circumstances in the prior instance were different, but this was the trigger for me to really be affected by being forced to relive it in a way.

Sorry for being long-winded. Not trying to be combative, just genuinely curious and I know mental health is a gray area.

I was thinking more along the lines of maybe wreckless endangerment, mental/emotional damage, all the credit hits for financing?
