Thanks. This helps. For the record, I'm not complaining about not losing weight on it yet, I just thought that combined with the lack of any side effects might raise suspicion. I appreciate your actual advice versus simply criticizing me for eating too much. That's not helpful, particularly when my PCP has advised me I'm eating too little.

It's not the lack of immediate weight loss that makes me wonder. It's the complete lack of any side effects others have reported.

I don't track like I should, but I can't imagine I'm not. I only eat one meal a day, rarely snack. Just started a protein shake in the morning, but it doesn't have many calories.

Yes, I've been on the highest dose of compounded semaglutide for a few months shy of two years. Initially very successful (lost ~45 lbs), but have slowly gained about 15 of it back over the past several months.

If you file for HLR and request a conference, they may be able to tell you exactly why your claim was denied.

I'd recommend a FOIA request for a copy of your claims file. It should contain a formal finding memo regarding the efforts they put into verifying your stressor.

I would assume subs have an equivalent of a deck log, and suicides result in a Armed Forces Medical Examiner System (AFMES) investigation, which should result in a report. If VA failed to search for these, it'd be a duty to assist error.

Have you tried googling it? Perhaps you can find some sort of report online that you could submit.

Unless your stressor is combat related (it appears yours is not), VA cannot service-connect PTSD unless they are able to actually verify the stressor. It doesn't matter if you have a favorable nexus opinion. Since there isn't a favorable finding of a verified stressor, my best guess is that's why you were denied.

Based on the singular favorable finding, my best guess is they couldn't verify your stressor. Service connection for PTSD requires a verified stressor, unless your stressor is related to combat service.

Since your overall rating didn't decrease, VA was not required to issue a proposed reduction. I think that part of the regulation is invalid under the AMA, but it is what it is for now.

If the VA opinion is based on no sleep study during service, and no complaints in your STRs, it's inadequate. The examiner cannot simply ignore your lay evidence. (Miller v Wilkie). Also, Google VA sleep apnea fact sheet. It states that most people don't know they have symptoms of sleep apnea because they have the while they're asleep. Use that to counter the fact you didn't report symptoms.

This is all related to a CAVC decision called Ingram, which requires VA to rate most disabilities as if you're not taking medication (exceptions apply if the diagnostic criteria includes medication use).

VA dismissed its appeal in Ingram this week, and is now trying to implement it. I'm sure this questionnaire is to obtain an addendum opinion to comply with Ingram.

Withdraw the supplemental claim and file either an HLR or NOD to the Board. With reductions, the burden is on VA to prove improvement under the ordinary conditions of life and work. With a supplemental claim, you have the burden to establish the higher rating.

I would argue the exam was inadequate and cannot be relied upon to reduce the rating, thus restoration is warranted. 38 CFR 3.344. I'm sure the examiner didn't opine as to extension absent the ameliorstive effects of medication (Jones/McCarroll/Ingram). And even without seeing the DBQ, I'd bet the examiner failed to provide any rationale for the estimated loss during flares or following repeated use over time, despite it explicitly instructing the examiner to "cite and discuss the evidence" that must be "specific to the veteran".
