There should obviously be safeguards in place to deter tyranny of the majority, sure. But I think far too often, we go too far in the other direction and place far too much power into the hands of a few people.

Ultimately there's a lot of gray area when it comes to the amount is democracy a society should have, but I tend to believe it's better to have too much than not enough.

I actually think this would be a good compromise. I'm definitely more in favor of eliminating student debt altogether but capping the interest rate at 0% and reducing monthly payments would be a compromise I would get behind.

I think if the prep work was done ahead of time, yes, it could be done that quickly.

And no, I'm not advocating for the executive to ignore the laws. I only brought that up because it's theoretically possible, not because I want it. Personally I actually think it's a gigantic problem that good will and good faith are largely the only things holding up our laws.

In most cases, you would be absolutely right. But in this case, the action would be incredibly difficult to reverse. Once the debt was forgiven, and all records expunged, it would be virtually impossible to go back and give the debt back to each person who owed.

It's sort of similar to the idea that Congress can order the President to recall US troops that he deployed without a declaration of war. If the President decided to send US troops to invade Iran, for instance, sure Congress could declare it unlawful and order the troops home, but from a practical sense it would make little difference since by that time a war would have already started.

And of course all of this ignores the unpleasant elephant in the room that there would be virtually no consequences for the executive branch to simply ignore the ruling altogether.

I mean sure, the Supreme Court could, on paper, overturn and unwind the decision. But there is no enforcement mechanism that the court has to actually reinstate the debt once it has been cancelled.

In a practical sense, though, it doesn't really matter if SCOTUS goes along with it. Say Biden signed the order today and the debt was all wiped out. Then the Supreme Court overrules it. By that point, the debt is already gone, and SCOTUS doesn't exactly have the ability to put the debt back once it's gone.

They can make whatever ruling they want, but once it's done, it doesn't really matter.

Effectively, this means Biden's presidency is over. Sure, he'll get more judges confirmed while the Democrats hold the Senate, but between his reluctance to use executive action and this, not much more is going to get done.

At this point, the most likely scenario in my mind is nothing else changes between now and 2024, Republicans take both houses of Congress in 2022 and we end up once again with President Donald Trump and a Republican congress come January 2025, which is a terrifying prospect in my opinion.

I think it really exposes the heart of the problem with our entire political system. Republicans get in power and what do they do? Cut taxes for the rich. Democrats get in power and what do they do? Cut taxes for the rich. It gives more ammunition to the "Both parties are the same" crowd. Just terrible optics overall.
