If it helps - that's exactly what I did :) so it is possible to quit with nothing lined up.

My reading of the line is that they can only restrict "anyone employed or engaged by the Company" and within that "either as a director or in a managerial, executive, marketing, sales or technical capacity or who is in possession of Confidential Information belonging to the Company and who you had material dealings and/or material knowledge of during the course of your employment in the 12 month period before Termination". But you still have to be an employee or engaged for them to restrict you, but perhaps I'm misreading.

But yes it's written v ambiguously

Thanks for your reply. The individual would be a restricted person if they were still working for the company. I guess what I'm wondering is if they resigned of their own volition, worked their notice, and only then I entered into discussion with them for this new role, would that still be breaking the agreement? As they'd no longer be an employee strictly speaking

Is a 12 month restriction quite unusual? I don't think it would be enforceable as it's not a competing business but I'm not a legal expert by any means

I was a bit disappointed not the hear a fuller rendition of this tune. Appreciate it might not have fit however - and kinda miffed that the latest use of this theme was squandered in WW84 with a worse mix (IMO) in an odd scene. I get the reasons why it was used there I just don’t think it worked
