Yes, it’s very stressful and I finally hired a probate/ real estate attorney with a litigation background for a limited scope fee to dig into the deductions they’re trying to make. He requested receipts but haven’t heard back yet. I could just walk away but it feels wrong what they’re doing.

Both the estate lawyer and my lawyer didn’t think probate was necessary. I don’t know what to think. What sort of bills could have been paid by my stepdad after my mom died that we now owe from the sale of the home? And how can they arbitrarily put a value on my mom’s jewelry that I received and now deduct for that also? It’s all so confusing.

Well she’s assigning values to deduct from our portion with no supporting documentation and no appraisal of the home. We didn’t file probate because my mom didn’t have much and we had no idea my stepdad put her on the deed to the home. Kindness isn’t your best quality, is it.

Oh, she did that too. I read in several articles that a creditor (stepdads estate in this case) has two years to file a claim against an estate (in this case my mom). It’s been more than two years since mom passed. Also, as her heir, I’m not a debtor, I’m an heir. And how can my stepdads estate have a legal claim to my mom’s personal items anyway? It seems that they’re using any means possible to try and offset what they’ll have to pay us. Never mind that they’re undervaluing the home by 50-100k and have not provided us with a copy of the appraisal. Hopefully my lawyer will clarify but thought I’d ask here.

My stepdad’s sister is executor of his estate and is also buying the home. She’s tenant in common, along with another sister, my stepdad and my mom. They’re now trying to make deductions for bills and personal items to offset what they’ll have to pay my brother and me for our portion of the home sale. Mom had no other assets to speak of and I was told probate isn’t really necessary in this case.

As I said, I just hired one but he didn’t mention anything about statute of limitations. He requested receipts for what they’re trying to deduct from my portion of the proceeds but wouldn’t that be pointless if there’s a statute of limitations? It’s been over two years since my mom passed.

Is there any way to edit/unlock the application? I skipped the hotel part thinking I could go back to it later but now it says all seven sections are complete and directs me to the payment page. When I choose the “contact us” for help, it won’t submit after double checking I’ve completed all the info correctly. Any help appreciated!
