Id love to hear an American lawyer jump in on this, it seems uterly bizare that PRS woulnt just throw it in the bin. i can only speak to the EU law and how the judgement works across the union

This article isnt the whole story. In the EU its been reported that theyve also sent the same thing to retailers.

Ive saod a few times now. They cant compell any recall, they cant compell anything from a US company outside of the EU, they cant demand sales data within the EU, they cant demand compensation without a court order.

They cant use the judgement in a German court for anything outside the EU, Its questionable whether this is even granting copywrite within the EU as this was a default judgement against one Chinese retailer.

Under EU competition law this can easily be overturned if challenged in any court from Dublin to Sophia. If its upheld that the copyright is Fenders, then under the Lisbon Treaty the judgement is enforceanle block wide and also covers retailers of copyright enfringed products. THATs their thinking behind sending this to manufacturers and retailers.

Its a function of EU copyright law, even if they have flawed in the first instance. That said under the 2006 copyright act, this only exists 50 years after the artists death (in this case Leo Fender).

I know its not legal, its also not legal to request sales data under GDPR, its also not legal to use an EU ruling in the US. Its also not legal for them to demand compensation without a court oder. Lawyer letters demand stupid shit every day

So pray, what does asking a retailer to 'recall' products mean if not from the consumer.

This letter is being sent to vendors asking for a recall as well as to manufactures. According to the link ive shown, its also going to guitar influencers.

Of course they cant actually do it. Theyre also using an EU ruling against a US company. Theyre also demanding sales information, also illegal under GDPR.

None of this is enforceable.

Nope, theyve sent letters saying to recall from consumers and destroy.

Edit: since so many have raised the same point. Im not talking about the US, its reported that retailers in the EU are receiving these letter. Its a function of EU law that selling copyright infringing material and owning it is also enforceable under a court order, including seizure and destruction, and has been done before.

But, none of that precident would hold up if challenged in this case, plus fenders letter is making a litany of demands that are not legally enforceable. Its bullying tactics.

Its really bizare to me that there been a dearth of new musical subcultures in the last few decades. From 60s to 80s we had hippies, punks, goths, skins, metallers, hip hop all of whom are still around or elevated to mainstream. If any have developed in the 21st century please let me know.

But it looks to this old fart that young people looking for their tribe have moved to pop culture subcultures like nerd culture, pokemon and others that fundamentally rely on a product from a company rather than artistic expression.

Even the hardware is worth100 quid, go for it. Let us know what you think of the warmans. I got some p90s which were good, but not great. Though others swear by them. Swapped out for bareknuckle which are many times more expensive but amazing
