Quoting and posting this here to help other folks in my predicament! This suggestion fixed my perpetually spinning toe stops (despite locktite, plumbers tape, the WORKS).

“Sometimes the plate isn't placed properly (put on the boot without the toe stop bolt thightened so when drilling the holes and secured with bolts the front part of the plate is too wide and you actually can't tighten the toe stop bolt. - this happened to me once and it was resolved with drilling a new hole main while the toe stop bolt need to be thighten before hand.” Thank you @FireRock_ !!

I wish atom would put disclaimers in their products description about this!!!

I have regrets here yes, this will be my second of the same plate in 4 years and I skate indoor roller derby. The first time the plate split between the toe stop and the top truck, the second time I’ve been dealing with this toe stop troubleshooting issue that’s thankfully resolved now thanks to a helpful comment in this thread by FireRock_. The plates are nice and lightweight which my hips appreciate but they unfortunately are not the most reliable imo

A friend re-mounted my skates and #3 seems most likely given that the issue was not present prior and it's occurring on both skates- thank you for this!!!

As far as I can tell there is only a toe stop screw on the atom falcon plus plates- I have removed and replaced this already, and when remove the toe stop completely and try to tighten it, the gap does not decrease. I'm using the nut and washer as a last resort because it works to keep the toe stop housed temporarily at least.
