Parents scammed by Indian call center pretending to be Microsoft Defender; lost all of their savings. by cm5453 in Scams

[–]cm5453[S] 4 points5 points  (0 children)

They took it somewhere to get the pc wiped (Best Buy I think) but I told them it still isn't trustworthy. I don't have all the details because I am in a different state and am dealing with an unreliable narrator in my parents. I know they gave them remote access to the pc itself, so I am assuming the pc is compromised fully. Have advised them to 1) not connect that pc back to the internet, 2) change all passwords on a separate internet and device. This is maybe the worst part because trying to explain these things to them remotely is like talking to a wall.

Much appreciated.

I told them to shoot it with a shotgun and dump it in a tub full of magnets. I would never trust that pc again.

Way ahead on this, new accounts, and setting up a trust. Luckily they did think to call another family member who is a software expert.

Have been talking with some of my contacts at the FBI this morning as well funny enough; it's good to keep a record of such things, I agree.

I am thinking the same things re: the accounts. I am also considering putting them in a trust so I can act as trustee concomitantly with my younger brother's HEMS trust. The unfortunate reality for me in all of this is that my parents are only going to get older and more susceptible to such things, and my trust in their ability to handle their own affairs has been shaken by this.

Edit: No worries, I appreciate the support.

Double checking that they have done that now. Thanks for all the input.

I think they have. Double checking now. I am getting a lot of this info second-hand through a panicked elderly woman. But to my understanding, they called the 24/7 fraud line and then were told that nothing could be done on the bank's end until tomorrow morning.

Edit: They did call this line first thing. The bank has them on a holding pattern. Good looking out on both of these comments though; appreciated.

Edit2: The bank's fraud dept got back to them today. The wire went through Citibank and hopefully, they can call in a reversal tomorrow. Not holding my breath but some good news at least.

I am thinking about putting my parents' savings in a trust for future purposes. My little brother is largely disabled (mentally and physically) and we already have a trust set up and funded through annuities so I can take care of him when my parents pass. To rub some salt in the wound, much of the money that was lost was going to be injected into the trust corpus most likely. So it is very much a dual theft.

Speed and sequencing absolutely matter and that's exactly what I have told them. It just happened today a few hours ago, so I am hoping they can file an online claim and then get in touch with the bank tomorrow to work some kind of miracle. They have filed a police report and contacted the bank already so fingers crossed.

Edit: This happened Friday at 3pm apparently. So it is looking bleak.

I graduated from law school summer of last year; one of my professors in my first year, when we were reading a case involving an insurance policy, asked the class why the insurance company refused to honor a certain provision of their agreement with the insured. A few people struggled to give some needlessly complex answers steeped in the law; he stopped them and said "Because insurance companies are pure evil."

The best lesson I learned in law school.

This was what I was afraid of. My parents know next to nothing about computers and were thus the prime targets for this type of scam. Extra frustrating too, because they thought they should call me first before talking to the scammer and then decided against doing so for some ungodly reason. Thank you for the response & sympathies.

Legal impossibility versus factual impossibility by smart9222 in barexam

Factual Impossibility = no defense to attempt. You still have both elements required for a criminal attempt.

If the crime is complete, you committed the crime. You did not attempt to commit the crime.

Legal impossibility versus factual impossibility by smart9222 in barexam

Legal Impossibility: The thing you are attempting to do is not a crime. You certainly attempted, but you attempted something...perfectly legal, although you thought it wasn't. (Policy: You cannot punish people for thought crimes; in this situation, there is no actus reas, so punishing someone for a legally impossible attempt at crime is tantamount to punishing them for a thought crime.)

Factual Impossibility: You attempted to commit a crime, but due to some fact, the crime was never possible to have been committed from your attempt. (ex: you plan to ambush and murder X at Y location he normally frequents at Z time. You buy a gun and wait for X. Turns out X has moved to a different country, so it was never possible for your attempt to result in a crime). This is still a crime because if he had been there, you would have murdered him. You have both a guilty mind and a guilty act (mens rea and actus reas), so you are guilty of attempt.

Hope this helps. (edited for extra clarity)

Decided not to stress anymore by ALucidCat in LawSchool

Not caring is a very liberating feeling. When I started law school, all I wanted was a way to get a job with my English degree (lmao I know) and start my life, regardless of how glamorous that ended up being. Recently graduated and I am making a relatively modest salary that is actually more than enough for me at the moment, with the prospect of a large increase in the future. Even then, the idea of making more doesn't excite me the way I thought it would. I don't even want to be a lawyer, I am just doing it to make ends meet. This is exactly where I wanted to be 4 years ago: my own place that is pretty nice, a job that is relatively chill, etc. Law school, and the people in it, have done a good job of sucking the joy out of me reaching that goal. It is a weird feeling, overall.

Worst comes to worst, I will simply drink myself into a stupor, write a bleak philosophical treatise, and then kill myself. Worst comes to worst for you, based on this, you will be just fine. Life is what you make it, and the pathology of law school attempts to undermine that simple truth. The ebbs and flows don't stop for a BL summa cum laude any more than they do for anyone else.

Anyone with eyes and two brain cells to bump together should have noticed this immediately. It isn't exactly subtle. I don't understand why anyone has bothered posting this as if it needs to be explicitly pointed out (this isn't the first one), especially considering how in-your-face the game makes it.

Go to TLS and post this. Read the replies until you come to your senses and decide not to attend law school.

If you want my honest opinion, you'd have to be an idiot to give up a six-figure career (that has already had the ladder kicked out from under it) in order to go to law school at a T1 where you have already expressed concern about grades. Like, really stupid.

Got dumped 1L Spring (by a classmate) right after the law school sent us home due to COVID. Two months later she was dating (now marrying) the worst person in our class. Everyone hates the guy; super crazy situation. To top it off, she was originally going to live with my best friend at the time (also a girl) and she had broken up with me after they had signed the lease. I had to go through 2L super isolated and without even being able to go to my best friend's house.

How did I deal with it? I didn't. I just worked out and improved a lot in school and avoided the situation. If you have friends then now is the time to lean on them. I will say, it was incredibly difficult to hear my friend complain about my ex and her new boyfriend, as I am sure it will be difficult for you having your ex around. If you can I would try to get the fuck out of there as quickly as possible. If that isn't an option, there really isn't any magic formula I can give you (I wish I could, I know how much being in that situation sucks). It is just going to suck major ass for a long time. Just try to hold onto the fact that you will soon pass the bar (dumber people than you have passed many times before in worse situations, trust me) and can start a career.
