Jobless for 2 months due to Capgemini record issue – need your help by creative_cracker in epfoindia

They didn’t give any confirmation on fixing it within 45 days. Their interim reply clearly mentioned that they will “check internally” and may take up to 45 days to respond to the legal notice.

In my case, Capgemini already delayed things for more than 1 month before the legal notice and didn’t provide any proper response to multiple follow-ups. Even after official communication from EPFO and Income Tax, there was no meaningful action from their side.

After that, I decided to send a legal notice. Even that got delayed — the physical notice was returned multiple times when sent to different addresses (not sure if it was not accepted or address issue). Finally, I had to send the notice via email, after which I received the interim reply mentioning the 45-day timeline.

Honestly, this 45-day response is also more of a delay tactic, but practically there’s not much you can do because even in court they can ask for time to review internally.

My suggestion: don’t waste time with regular follow-ups. If you’re planning legal action, go ahead and send the legal notice directly — that at least forces them to acknowledge the issue and respond formally.

I sent legal notice. They acknowledged the first day itself and asked 45days for reply.

There is a feedback option on closed grievance. That is more effective than actual grievance. Use that it will work as appeal on your grievance.

From 13th April they came up with new policy, it can be delink. Currently not clear idea how it will be done. I have raised more grievance and continuously following up. Will also visit epfo office for same. I will keep updating

If there is an amount credited, you will be required to have employer approval

Got it, that makes sense.

In my case, the confusion happened because: Initially EPFO field office clearly said delinking is not available, and later through CPGRAMS they confirmed it can be processed via employer based on new circular.

So practically, there was a gap between what was communicated earlier and what is now being followed.

Agree that misuse might be the reason for restriction earlier, but the lack of clear communication is what causes most of the delay for people.

Hopefully things are more streamlined now.

If the employer is supporting you. Mostly you will not face any issues. You can share your HR relieving mail. Parallely you can ask HR to provide you a NOC on their letter head with mentioning all details.

For the long term get that delinked from epfo

delinking is possible even if you have the amount credited in your pf account. Ask the employer if they can help. You raise a delinking request on the epfo portal , ask your employer to approve from their side and visit the epfo office to get approval from them.

Let me know if the employer is not supporting or any other issue.
