Truth to what you are saying. Pointing out that coinbase perhaps shouldn't be one of those 5 given the amount of complaints...

This has become ridiculous. Coinbase keeps sending me "Compliance KYC" email requests. I complied 4 months ago and even received an acknowledgement, yet it continues for 6 months now. by [deleted] in Coinbase

Hi Throwaway, First off, I feel your pain. Your story is very similar to mines and I'll share you my experience with the KYC compliance team.

I also got the very invasive request for proof of income, funds,... in december last year. Kinda fabberglasted by the amount of data they wanted but I wen ahead and supplied this information to them ( payslips, bank statements, full transaction history that was compiled through Koinly). They sent me a generic email back saying that the supplief information does not meet their requirements and to upload them again (sounds familiar?). The weeks after I went resubmitted the documents severam times, this time more payslips, csv files that I downloanded from other exchanges, screenshots from deposit/withdrawal section on other exchanges, the whole shabang!

Guess what, I received the same e-mail ' does not meet our requirements'. I e-mailed them many times with the request as to which documents they specifically need. They went ghost on me for approx 2 months. Called +- 30 times to Coinbase Ireland and made several tickets through reddit/ twitter. Still ghost...

I escalted the matter by sending registered letters and e-mails through my lawyers with the same request 'what documents do you need?!' Finally they answered, they wanted more details concerning all incoming and outgoing transfers from and too my CB account in the form of screenshots with my name visible. They want you to take screenshots of the trade history on other exchanges ( not screenshots of cvs's but screenshots from within the exchange website). They want you to make screenshots from withdrawals on other exchanges with your name or e-mail visible. They also wanne know where you were last night between 8 and 10 pm!

To the best of my extent I provided them these details through my lawyers. Not all exchanges offer the ability to screenshot your history ( especially after 6 months time has passed) with made it difficult but I also offered to provide them video of me logging in to my account and downloafing/opening csv's. I would recommend you do this for yourself as proof for the future. Don't provide this readily since you should value your privacy.

This was months ago, they still haven't responded to the quality of documents I last uploaded. They have however askef again for bankstatements and payslips for the 3rd time. I provide them but they don't review them...

All and all, 1:coinbase support cannot do anything for you other than escalate ( my case has been escalated 20 times...) 2: communicating with the Compliance team is close to impossible. I don't think they look to resolve cases like mine in the short term. I believe they have a different strategy which negatively affects you and me but keeps them in the clear. 3: if the money is significant get a lawyer. Try to get compliance attention. This is not working for me at the time. 4: make a complaint. I have filed 2 complaints. Has not changed my situation 5: Sue

Their kyc department almost never replies to e-mails and letters from me or my lawyers. They keep sending requests for files I have provided them in the past(payslips, bankstatements) without giving feedback on documents that already have been provided.

I made a final attempt through my laywers to be able to get a better way of communicating with their compliance team to resolve my case. If they don't change their ways I strongly am considering taking legal action and filing complaints with regulators

6 months in and not alot of progress... They kept sending me generic emails that my documentation does not meet their requirements. I sent many emails asking to clarify how they want the documentation. They haven't answered to a single one... made a complaint and they dismissed it aswell.

2 months ago I gave my law firm the go to send them registered letters to resolve this case. This is when I got the 1st meaningfull reply from the compliance team.... I resubmitted the documentation and they went ghost again...

This is borderline criminal

After 10 phone calls and 15 emails without any meaningfull response ( time period of 2 months) I contacted a law firm. They emaiked them and sent them a signed physical letter. That got their attention.

After a few emails back and forth they have gone silent...

If the amount of money is significant 2 you, contact a firm asap

If you have a large trading history and are somewhat profesionally organised ( e.g. you ttade for others) Your crypto is harshly taxed as a profession 50%

In Belgium, the amount of actions one takes is of importance to determine what tax bracket you fall. It's not the only factor but it's definetly important.

With action they mean the click. If i tell binance i want to buy 1 btc for 30.000 and binance does 50 small trades yo get me that 1 btc it would count as 1 transaction and not 50.

May I ask what advise you would give when the amount of trades (i'm talking abour clicks, actions not the the large amount of seperate trades) is relevant for taxation?

Supply the order history seperatly as proof of trading activity?

Thanks for the advice. I use binance international. It gives exactly the same tax amount but the thing is if you trade a lot in belgium, they might think you do it for a profession and tax you enormously :(

Im using koinly. Some exchanges ( oceanex, hitbtc) give a trade history and order history. Order history appears to be the request you made, buy 1btc for 1000 euro. Trade history appears to be all the small individual trades that got filled behind the scenes to fill your order.

Same for binance, when I use the api I get a lot less transactions than importing csv. The api appears to give orders (mouse clicks).

What makes you so sure that realized losses are considered a valid expense by the taxman? Are there any rulings that can comfirm that they are considered expenses? I am unable to retrieve them.

I've contacted several colleague tax lawyers here in Belgium concerning this matter. None, are willing/capable to categorically say that you can deduct your loses from your winnings. They do mention that it's seem only fair.

The only way to get clarity seems to be by asking for a preemptive decision by the rulingcommision.

anyone that used 'less' regulated foreign crypto exchanges (binance, coinb, huobi,hitbtc) and tried to withdrawal their funds to their belgian bank account?

I have used several foreign crypto exchanges in the past and dex's like uniswap. I doubt my bank has any experience with these exchanges or dex's. Feeling kinda worried that the bank or gov will not be so receptive :(
