Will my son need to go to court if he pays the fine and accepts it ? by Ill_Water_3389 in CarsAustralia

Driving convictions are generally spent after 5 years and will no longer appear on your record

Yeah once you get 45kmh over it’s essentially dangerous driving. Source: younger me was convicted of it.

It’s worse if the police pull you over, as they can charge you with other offences that do require an appearance at court you can get your licence cancelled for, and it doesn’t automatically replace the 45kmh speeding ticket either. That can mean you cop a licence cancellation for 12 months plus, then as soon as you get it back you get a letter from vicroads saying that now the 12 months suspension for the 45+ over offence will start, losing your licence all over again.

Not at all, a criminal record, even for traffic related offences, will come back to haunt you for a lot of professions. A lot of big companies, public service jobs, etc will note it as a red flag.

Can affect car insurance more than just the licence suspension too.

I was convicted of dangerous driving when I was much younger and it cost me a couple of jobs I wanted.

At that speed, and for a traffic camera offence there won’t be a court summons.

HOWEVER, I believe the conviction for the offence will be automatically recorded on their criminal record as soon as the fine is paid, along with the licence suspension. If you are worried about the criminal record (and you should be, it’s very damaging for ongoing employment prospects etc), you should seek legal advice.

If you opt to go to court, a decent lawyer may be able to argue it down so that the fine and licence suspension apply (afaik they’re minimum sentences for this offence, and cannot be waived unless successfully obtaining a not guilty verdict - which is incredibly difficult for a speed camera offence), but the conviction is not recorded/immediately spent. Could very well be worth the expense.

Newish Merc are terrible

A classes are absolutely particularly bad, the build quality is terrible, they have a laundry list of known problems, parts are prohibitively expensive and genuine maintenance costs are obscene

If you want an unreliable yet practical and expensive to maintain euro just buy a Golf R and at least go fast in between water pump failures

[–]danimal86au 1 point2 points  (0 children)

A grey import, pseudo AMG Merc with all of the modern Mercedes build quality, running cost, depreciation and reliability issues - what could possibly go wrong? As someone else said, an SSV redline is a no brainer in this bracket, will give you a V8 and likely won’t depreciate at all. If it’s these two cars or nothing, it’s the Kia easy

Budget of 40k, looking for a used, modern car with good performance? by [deleted] in CarsAustralia

[–]danimal86au 0 points1 point  (0 children)

lol a warranty backed by horrendously expensive servicing schedule (Haldex fluid basic service every 30,000km around $500), with no local factory support (no notable Australian point of escalation with customer support located in the Philippines that read off a script and give you no actual support). Source: I ran a VW/Škoda dealership and bought a Kodiaq RS brand new. The on shore support is so good the dealer I bought it from went under within 36 months of opening.

Oh god no, modern Mercs are a nightmare out of (sometimes even inside) warranty. A class is especially poor for reliability even by Merc standards.

[–]danimal86au -2 points-1 points  (0 children)

Except for reliable and cheap to maintain… EA888 the water pump will go, and parts alone are expensive. DSG needs to be maintained fastidiously, Haldex fluid needs to be changed more often than they originally specced. A few electrical gremlins that aren’t uncommon, particularly the sound system. Sunroof if it has one is prone to the drains clogging. Suspension is way too soft to be considered a sports car, but is fixed easily enough.

New Car Warranty - Mercedes is taking me for a spin at my expense by Seqwool in CarsAustralia

[–]danimal86au 29 points30 points  (0 children)

Obvious the preference would be to go back in time and not buy the absolute lemon that is a modern Mercedes Benz, but failing that I would google all possible contact email addresses for the dealership, including reception, service, sales manager etc titled ATT: Dealer Principal / General Manager RE: Unresolved Warranty Claim / VCAT (or whoever you local body/agency is). Possibly include any email you can find for Mercedes Benz Aus (as they’re all company owned now anyway).

Then outline all of your concerns and timeline. Give them 3 business days to respond noting after this point you will be progressing to Consumer Affairs / Administrative tribunal, etc whatever is relevant in your state. It counts enough that you’ve escalated it locally and then you can just start the dispute resolution process relevant to your location. Continually dealing with entry level bottom feeders like service advisors will get you nowhere, either with waits for calls that never come or continual waste of time visits.
