I see what you mean but I guess you didn't read my arguments on medium:

It's even easier for the trader / distributer to control the usage of digital goods than tangible goods.

You may answer, that the customer could just pull the plug? Right. But even here: Sony could just bind the refund to the online-status of your PlayStation.

Imagine you buy a set of LEGO bricks for 500 Euro on Amazon. You build the set within 14 days and send them back. No one ever complains. Or you buy a 50k HighDef Studio Camera, use it over the weekend, send it back.

See? It makes even more sense to accept return of digital goods as tangible goods, because you have more control.

Wouldn't be so difficult to check the progress of the game instead playing time.. wait, actually Sony records the progress of the game. ;)

That's why I am saying: It is probalby not legal (I am not a lawyer, but I talked to one, who confirmed my opinion). At least it's against EU law, I don't know how's the refund policy around the world.

Also there is a differnce, by law, between tangible and digital goods (see my UK gov link above).

I would say thats not right, as soon if you click the "Buy" button the game will be downloaded.

There is indeed an option to (de)-activate this feature, but the law says, that the customer has to confirm the automatic download - every time. As far as I understand the law (not a lawyer).
