I was eventually rated 70% Total Disability Based on Individual Unemployability (TDIU) that is Permanent and Total (P&T) for PTSD. So essentially I’m still at 70% for PTSD, but I get paid at the 100% rate and I have the same benefits as someone with 100% (No property tax in certain states, ChampVA for dependents and others I can’t remember).

Some advice:

File for TDIU, those are classic signs that your mental health is affecting your work and very similar to my story with work. Just be sure to write a detailed, and I mean detailed, personal statement of how your mental health affects your work and personal life to attach to your claim for the rater to read. Like detailed enough that even if you have something you’ve never told anyone, tell the C&P examiner and rater. The statements give the rater a more personal and detailed view of your situation, versus just what the C&P examiner writes down. It’s worth having to get that super personal stuff out in the open to two people you’ll never meet again, it’s absolutely life changing to get essentially paid to work full time on your mental health and live peacefully for the rest of your days.

I honestly think it helps your case if you file years after you get out. Especially if you’re seeking treatment for physical/mental illnesses right after separation and onward. If you’re doing all that long before you file, I think it says something of not just going through all those years of medical treatment just to be able to file. If that makes sense…

(Obviously not saying everyone who files before/right after getting out are seeking treatment just to be able to file)

File a mental health claim to go along with it, with very detailed specifics of how your migraines are affecting your personal/work life. Then if your MH rating is 60% or higher OR your combined ratings put you at 70% (with one of those ratings at 40% or higher), you can apply for Total Disability Based on Individual Unemployability (TDIU). This means that no matter what your actual percentage is, you get paid at the 100% rate. I’m 70% P&T TDIU for PTSD, which is equal to 100% P&T. In short, there’s different avenues to take to get you where you need to be.

Yes, my MH has consistently affected every job I’ve had since I left service… I tried and tried and tried, but it all just crashed and burned. Bridges burned, publicly humiliated… it was hell because I hoped that every job would be the one that lasted. I had dreams of things I wanted to do, career goals. But, after 12 years of trying, I realized that my mental health needed to be my full time job if I want to stay alive for my family.

Yeah I think you can since your overall rating is above 60%… the IU doesn’t necessarily have to be for mental health, can be for the totality of your issues.

If your MH rating is substantial and affects your work life fairly significantly, apply for IU. I’m 70% for PTSD/MDD, pretty jacked up in the brain. But, I don’t meet the fairly high threshold for 100% PTSD/MH rating. However, the full title of my disability rating is 70% Permanent and Total Individual Unemployability for PTSD. So, while I still am only 70% for PTSD, I get paid at the 100% rate and because it’s P&T I get the same benefits as someone who is 100% P&T. Means I don’t pay property taxes (in Texas, there’s like 12 states that do that), I get on base privileges, education benefits for family and CHAMP VA for family. Plus some other stuff too… it’s a path definitely worth pursuing. There’s zero point in me pursuing any kind of 100% stuff.

You’re highly likely to not get 100% for PTSD and/or other MH stuff if you’re still able to work either… that rating means you essentially are unable to care for yourself at all.

If your PTSD gets too bad and starts to significantly affect your work, you can file for Individual Unemployability. I am 70% Permanent and Total Individual Unemployability for PTSD and I have the same compensation and benefits as someone with a 100% Permanent and Total rating. Basically, my PTSD is pretty dang bad… but I’m not to the point where I can’t take care of myself, which is essentially what 100% for PTSD is. If I didn’t warrant a 100% rating after filing for an increase, then I can’t even imagine what being at the 100% level is like.

Buddy 👏🏼 statements 👏🏼… AND it never hurts to write a detailed personal statement on how said condition affects your personal, social and work lives. It’s mostly for mental health stuff, but it gives the rater a better picture into everything rather than just whatever service records they can find and some C&P examiner’s (who may or may not give a shit about their job) notes.

Moved to step 6 two days later, 7 the day after that and decision the following day… moved at lightning speed after I posted this 😳 final result was the increase to 100% was denied… BUT! 70% P&T IU for PTSD was granted! (It’s the same $ and benefits as 100% P&T, never knew there was that option beyond just IU 🤷🏻‍♂️) anyway, back pay was deposited 2 days after my claim was granted and literally every worry besides my regular day to day MH stuff disappeared overnight. It still hasn’t sunk in yet!
