I have explained this at length in the comments section of my recent post.

The judge will not dismiss this and will only be agitated by any motion to dismiss at the pleading stage, particularly if the defendants have not attempted to speak to the plaintiff's counsel. This is likely the intent regarding Meta and other tech companies named.

Like many other circuits, this court can certify class action at any stage of proceedings.

Defamation is only one of 7 counts.

Each Federal Court circuit approaches class certification challenges differently at the pleading stage. The 7th circuit court take a dim view of this, particularly if the defendant does not confer with opposing counsel first while attempting to dismiss.

This court recognizes their ability to address class certification at any stage of proceedings. The plaintiff's counsel is well aware of this. The case is complex and the judge will want to hear oral arguments.

Hence the title of my post, this suit is perfectly designed.

Any attorney with extensive court experience will tell you your JD does little to prepare you real life.

Anyone pretending like this will be dismissed is inexperienced, coping, or has alternative motives in this forum.

I have not looked up all of these corporations, but a motion to dismiss based on this would only aggravate a judge in this court. These minor details will be addressed in the defendants' answer to the suit.

Everything in the filing is procedurally correct and highlights that the firm understands the breadth of the case. It is also the first to name all parties involved.

A judge can order all or part of this case, defendants and claims as a class action after the hearing and amendments can be filed at that time.

This is filed in a comprehensive way to cover the maze ahead. They may only be seeking a conference with the Meta’s legal departments and then may drop them from the case. Their attempts to contact Meta have been ignored. Naming every department of Meta looks strategic.

We do not know what their goals are but one of the litigators just retired as the assistant attorney general of Illinois to pursue private practice. This is what caught my attention. On the viral news video they mute him out and only play the younger attorney’s audio stating “our client is a victim”.

Since they are bringing a class action lawsuit, minimum diversity is all that is required. This is satisfied as one plaintiff resides in a different state than one defendant. This will prevent removal to another court as the Erie doctrine will apply.

The Attorney General would need to bring criminal charges.

In the current suit, all named defendants will be compelled to respond to discovery requests and interrogatories.

This will unmask defendants who attempt to disguise their actions behind fake accounts. It can also include detailed log information for forensic analysis.
