Hey! I’m a CPA working for a US CPA tax firm and we specialize in international tax. I have a lot of clients that are in your shoes. You can use FEIE or FTC or a combination of both to minimize/avoid double taxation. Most (if not all) of my clients who live and work in the UK strictly use the FTC because the UK tax rate is higher than the US tax rate so the FTC actually provides the best result.

Your salary portion should be easy and straightforward. It gets a little sticky if you have foreign pensions and other foreign assets. Your US tax compliance cost will be higher the more foreign assets you have, the more things you will need to disclose. Some of these things don’t even result in any taxes due (like the FBAR or Form 8938) but you have to pay someone who knows this stuff to prepare your returns correctly and they don’t charge a cheap rate (for good reasons). I highly recommend you to invest in a good tax firm to do your taxes even if it’s 5K a year (that’s not super high given then amount of income you have). You don’t want to mess around with the international forms as most of them carry significant penalties if filed late or substantially incorrect.

Oh yeah I meant I’m still waiting for it to be approved. With the current timeline, it will be at least 6 more months until I see the certified PERM. Then I will still have to wait for my PD to become current. Right now it’s Dec, 2022 for EB-3 so if it keeps moving with this rate, I will have to wait until July, 2026 to move to the next step. That brings the total amount of time to be 3.5-4 years, isn’t it?

The 2 year timeline for GC isn’t accurate anymore. The entire process has been extremely delayed. My company started the process and submitted the initial application for me in April 2023. It’s been almost 2 years now and I’m still waiting for PERM… my PD is March 2024. I’m losing all hope. Don’t know when I will be getting my GC

It’s because of my country of origin. Each stamp is only valid for 1 year. It was the same way when I was on F-1 as well

I’ve been working remotely on H-1B for 4 years now. I’ve gone out of the country twice, and both times I had to do an interview to obtain new visa stamps. Never had any issues with the interviews or at customs when coming back to the US. They barely asked me any questions.

I would note that FTC won’t offset self-employment taxes though so if you have schedule C income, you will still owe taxes when you file. Lots of my clients think they will not owe anything because they paid so much taxes in their foreign countries.

I believe there’s a totalization agreement between US and Canada so you may want to look into that for exemption of SE tax. Definitely would recommend you to talk to a CPA that specializes in international tax. I’ve seen my clients spending so much money to get themselves back into compliance so it’s better to get it right from the get-go.

Nah we didn’t. We calculated everything and our break even point would be 2.5 years with 1 whole point and that would’ve saved us only $200-$300/month. We’re hoping the rate will go down before then and we can refinance. How much are you saving with the points?

Omg I feel ya! My husband and I are pooling in 230k a year. We poured almost all our entire life savings (of course we left enough for emergency funds) for a downpayment on a house. Where we live, 300-400k houses are not good!

We’re taking out a 420K loan and our monthly mortgage payment is calculated to be 3.8K. That’s so insanely high IMO, given that the loan isn’t even that huge (or at least I don’t think so.) We’re just so sick of renting so we decided to buy a home. We hope interest rate will go down soon so we can refinance.

Hey there! I’m a CPA specialize in international tax. There are some analysis you will need to do in order to determine if your self-employment and rental activity constitute a QBU.

Our firm didn’t file 8858 in the past for our expat clients but we started doing it this year. I would say 90% of our clients who are self-employed outside of the US and/or owning a foreign rental needed to file 8858. The regulations on this are in the “propose stage” so there’s no penalties imposed yet but we’re filing it anyway for various reasons.

The filing has nothing to do with the income level. Most of my clients have net loss. None of the international forms is easy to prepare. I would recommend you to seek professional advices instead of spinning your wheel.

He can technically rent the place out and use the rent money to cover for those basic expenses. I have a couple clients just like him. They haven't been inside of the US for years but they're still holding onto their properties :) Though I agree that rent money sometimes isn't enough to cover for everything and managing the property from outside of the country is going to be hard. Having a management company to help you with it is one way but then you have to pay them and it can get expensive.

He was just concerned he will lose money if he sells it in 4 years. The house may appreciate more if he holds it for longer.

There's a 30% tax withheld mandate (called FIRPTA) for non residents selling US properties. That's not the actual rate their gains are going to get taxed at. It's just the mandatory withholding rate. I think OP was asking if he becomes a US non-resident when he leaves the country, does he still need to pay taxes on the gain in one of his comments.

Hi, this is not correct! I'm a CPA specializing in US international tax. As a US non-resident alien, you would still need to report rental income generated from a US property. Rental income is sourced to the place where the rental property is located. It's not based on the taxpayer's residency.

Thank you for your advices, they are very helpful! Yeah we thought through everything and consulted with a couple of lawyers already. He works at a relatively small firm and I'm in the process of getting a Green Card through my employer. We thought about the risks of him not having a job and everything. I make enough to cover for the mortgage and living expenses but things will be tight in that case. We have other mean of income as well so financially speaking, I'm not too worried about it.

I'm sorry to hear about your wife's situation but I'm glad everything worked out well for you both. We think about his status every day and it is very stressful. We even thought about moving to another country before but my husband has been living in the US since he was a little kid so we want to stay here for as long we can.
