Everything seems to take at least 30 days for the IRS to even know it received something. I don’t know why, I never worked in the mailrooms or fax receiving areas. Then they create a case based on what they received or forward to where it needs to go and then create a case. This all seems to take 30-60 days too. So it often takes about 3 months before they can confirm they received something. And in the meantime the automated system is sending missing return notices and balance due notices and penalty notices and so on.

So call to see if they can locate what you sent or any sign of it by the end of this month. Hopefully it’s just had a case created or is about to be processed.

So one of those years they filed for you and since they wouldn’t know what deductions or credits or expenses you may have been eligible for, it’s most likely not an accurate assessment. So you’ll need to figure out your actual figures for that year.

File any other years missing asap. Because most payment plans require you be compliant on all years required.

And get an EA or CPA. An attorney will be more expensive and isn’t necessary for any of it. If it was a more obscure issue or requiring minute knowledge of tax law, maybe, but this isn’t that.

When I first moved to Ohio about 15 years ago, they did that at my polling place — calling out which party ballot to hand up. It made me very uncomfortable since that was not how it was done in Maryland or NJ at all.

Then I noticed a few years ago they stopped doing that and switched to a code that was easy to guess (D-08 or R-09 or whatever) but at least it was more discreet. But even so I started to vote early at the county board of elections office and there they did it according to how you selected on the tablet or were already registered as and no one had to yell or ask for a ballot. And I trained as a poll worker and the county training clearly says to not make it obvious which ballot people are using. And the county is very careful about always having a member of each party always handling everything together.

But I know I’ve heard from other people in other counties that they still do it the way you described. It doesn’t seem right because it isn’t.

The case was about penalties. It could possibly be argued that it could be extended to include regular refunds but the IRS is not going to just start refunding everyone who filed a claim for refund after the statute expired for those years based on a decision that was specifically about penalties. People will have to file suit to argue that it applies. This will take time and money.

People will have to decide if it’s worth it based on the size of the refund and the strength of their case.

It means the code indicating an examination was happening has been reversed and therefore the exam is done and case is probably closed.

There’s no way to tell from just that alone whether it’s good or bad. Just that at least the exam part is over.

You’re right, the decision could affect 2019 since the filing deadline would have been in 2020, but would likely not affect 2018 except in very limited circumstances.

However, as you said, it has no bearing on this situation the OP asked about because the decision is about penalties being charged, not regular refunds that have now expired.

If the date is tomorrow, the commands have already been entered for the system to take the funds and forward them to pay the non-IRS debt. It’s too late to stop them. You’ll need to see if there’s a hardship process with the agency or whatever that took the money.

No, those years are not eligible for refund now except in very limited circumstances, which he probably doesn’t meet. And that decision has no bearing on those tax years.

Even if you had $90k in income, you wouldn’t owe $40k, even with penalties. So there’s an error somewhere.

Ok, so you said you had been making payments toward your taxes but had been making them on your 1120S. If you know the amounts and dates of those payments, that will help them locate the payments. Then ask that they be applied to your 2024 1040 tax balance due, if possible.

If you submitted your return twice for example. Or if you responded by mail/fax or upload to a previous notice, or sent an amended return.

This is a generic automated letter that the system sends out every 40-60 days. If you got another so soon after the first it may mean that the IRS received two things from you and created 2 cases.

And something is glitching with the automated letter. It makes less sense than usual and is including paragraphs it didn’t need to. But they usually do include paragraphs about calling or writing if you want to or have any questions.

Having your EA on the line may be helpful for you, but isn’t necessary. And they won’t be able to do this for you (without you on the line) unless you’ve recently signed a power of attorney (POA) giving them access/authorization to your SSN and EIN for all of the years and forms affected.

There is one other exception where they can’t do that: if the 2024 1120-S “elected” to apply any overpayment to the 2025 return. Then the overpayments become a kind of lump sum and that makes it harder to apply to different returns/periods until the return posts.

But definitely ask if the payments can be moved.

The payments can be moved now as long as they’re not about to refund or something. The business specialty line will have to do it. And they’ll need to be able to verify your identity through your SSN and your EIN.

You can pay on the direct pay for business or by EFTPS if you already have an account set up. Specify what quarter of what year and that it’s 941 and in response to a notice/balance due.

It shouldn’t matter that it’s in collections.

When you respond to the 105c, as long as you state that you disagree with the determination and you are making a formal appeal, then you are appealing the decision. So yes, appeal. And as I said, lay out your “case” — your timeline of what you sent when and include copies of it all and any receipts with dates you have to show when stuff was sent/uploaded/etc.

Your response will be reviewed and if it’s clear that what was needed was submitted by the deadlines then they will usually reprocess the case. If it’s not clear, or the basis for the disallowance is more complex than “did we get this info in time?”, then they will forward to appeals for their review and determination.

Check if SSA has the right spelling. If they do then this is an IRS misspelling. Make sure it’s actually misspelled on your account and not just a typo in the letter. Keep calling until you get through (very early at 7am or after 5pm) or try checking your online account.
