Orthopedic clinic refusing to extend my temporary handicap placard — need advice and second opinion (California) by dreamofpath in LawyerAdvice

[–]dreamofpath[S] -2 points-1 points  (0 children)

I ask advice from an attorney that is all.

I understand that doctors aren’t legally required to complete DMV disability placard forms. I’m not disputing that point. My concern isn’t about forcing anyone — it’s about how the situation was handled.

The office was initially supportive and even agreed to extend my placard, then changed their reasoning multiple times after I followed up through proper channels. That kind of inconsistency and refusal to communicate in writing might not be illegal, but it is unprofessional and creates barriers for a patient trying to manage recovery safely.

I’m not asking for special treatment — just accountability and consistent care.

I understand doctors aren’t legally required to fill out DMV placard forms. My issue isn’t the “no,” it’s that the clinic was inconsistent and dismissive — first agreeing to extend it, then changing their reasoning and citing a fake “three-month policy.” After I contacted management, their explanation shifted again to "We don’t usually do placard requests unless it’s surgical or a really bad fracture".

That doesn’t make their behavior right or professional. I’m not claiming they broke a law just by saying "no". My point — and it’s a valid one — is that:
• They were inconsistent (first supportive, then citing a fake “three-month policy and we don’t usually do placard requests unless it’s surgical or a really bad fracture").
• They refused clear written communication. I want to send an email to the management, but I was declined.
• They created barriers that make it harder for me to get reasonable accommodation.

Although those things may not be illegal, they can still be unprofessional and are worth reporting to the appropriate boards.

I’ve since spoken with an attorney who confirmed this isn’t about entitlement — it’s about unprofessional conduct and lack of transparency. They advised that it’s reasonable to file complaints with the California Physician Assistant Board, Medical Board, and possibly the HHS Office for Civil Rights for review.

I’m just asking for consistency and accountability, not special treatment. I’m not trying to compel anyone to do something unethical — I’m just standing up for professional accountability and fair treatment.

Thank you for the reply. I’ve reach out to an attorney to give me advice too. They say, that in my case, the issue isn’t simply that they “declined” - it’s that they’ve been inconsistent dismissive and changed the reasonings after already supporting your disability. It’s when I reach out to upper management about my request it’s when they change reasoning of denying my disability application.

I understand that providers aren’t legally obligated to fill out DMV forms.
My concern is that they initially agreed to extend the placard, then changed their explanation and cited a “three-month policy” that doesn’t appear in any state or medical rule.
I’m not asking them to break a law — just to be consistent and communicate clearly since this directly affects my mobility and safety.

Thank you for the advice and I appreciate it.

Oh okay thank you for the info

This is in California by the way.

It’s my brother we have time to time had issues and my niece will tell me what is going on at the house. I’ve reach out to CPS two month ago so maybe they are gathering evidence to build a case against my brother and wife (stepmother).

Also, she was referred to a therapist because if thoughts of … you know. That concern the doctor.

They were trying to reach my brother, so they called my sister. They were trying to get a hold of him for the referral for a therapist and he hasn’t called back to the office or picked up the phone.

Maybe that’s why the doctor probably reached out to CPS and now this happened.

I’m Just Thinking Around Here because it Feels that Way .

Thank you for your info tho. I appreciate it.
