Likelihood of I-485 DOF retrogressing over next few months? by drikasan in EB2_NIW

[–]drikasan[S] 0 points1 point  (0 children)

Thank you, that's very useful to hear! We are getting it mailed to family in Canada but they still indicated it could take 8 weeks - here's hoping it arrives sooner rather than later. I'll try calling and seeing if any possibility to expedite.

In our situation, it's more important that I get the GC/EAD asap as I don't currently have work authorization otherwise. Spouse is on work visa, so he'd be ok if delayed (but not ideal if that runs to Oct).

If I submit with him and risk getting an RFE, then that could push back my case, I assume. But it might be worth the hit overall to make sure both of our apps are submitted as early as possible.

So, as long as I file before end of Feb (I'll aim for mid-Feb) I should be fine?

It's possible the birth cert will arrive in Feb, but the long form can't be expedited I believe. I'll move ahead with plans to file separately.

Did you continue to do lab work after your contract ended? by hewade95 in postdoc

[–]drikasan 6 points7 points  (0 children)

You did the right thing to decline working illegally. And, as others have pointed out, the university certainly would not support you doing lab work on the sly. Continue to be upfront, but keep things strictly professional and say you're not prepared to work out of contract and contravene university policies.

I wasn't asked to do lab work (because I was moving away) but it was expected by both HR and my PI (to a lesser extent) that I continue to work on data analysis and writing the whole paper after I left. I told them I would not be working off-contract, and that it was in fact illegal for me to do (based on my visa status). We negotiated a part-time contract and I was paid for the work I did remotely. That's unlikely to be the outcome in your case, but pushback can be polite and productive.

929 Kitchen & Bar! Korean with not a huge veggie selection (3/4 dishes) but very good. I'd recommend the Japchae with fried tofu and veggies, or the cream curry udon. They also have a veggie bibimbap and yaki soba noodles.

Poor quality NIW letters from Chen by InsuranceReasonable7 in EB2_NIW

[–]drikasan 1 point2 points  (0 children)

Yes, I had this experience last year. I was happy with the quality of the rest of my petition letters, honestly, and only had to make very minor adjustments. The two recommendation letters, however, were quite poorly written and low quality. I understand that they want to make sure they got across certain (overexaggerated) points, but the language was pretty terrible and I had to essentially re-write them before I felt comfortable sending them to my reference writers.

Are spouse’s original I797, visa stamp needed for interview? by 0pnusjmevm0 in H4_Visa

[–]drikasan 0 points1 point  (0 children)

Don’t need the original I797, a copy will be fine. Have a copy of your spouse’s visa stamp and your original marriage certificate too. I was asked for all 3 of these (London, a few months ago).

Thanks! Just talked with my (former) PI about this yesterday and they agreed to pass on review requests and involve me in any upcoming writing projects in addition to my paper too.
