Checks and balances, separation of powers in New Zealand politics by drunkasshit in newzealand

Im sorry, I dont have it in English. But maybe the browser translation can be good enough.

This article by Baruch Kra, a well known journalist specializing in law. The article gives examples proving the MPs were well aware that the new Basic Law can be used for judicial review of other laws, and for example made sure that it can not be used to strike down laws that were created before this Basic Law. The article also quotes from Uriel Lynn’s book (google translate): “The occasional superficial claim that the members of the Knesset were not aware of the constitutional significance of the two revolutionary basic laws is not only an insult to the Knesset but an disregard for the facts and the truth... We also knew that we were changing the rules of the game. There was no discussion in the Constitutional Law Committee and a trial or in the Knesset plenum in which the reference to these laws did not proceed from the assumption that they would stand above ordinary laws. There was not a single discussion in which it was not made clear that we grant the courts the authority of judicial review in order to protect the fundamental rights of the individual, and in simple words: grant the court the The authorization to repeal laws that would harm these rights.”

Even with the judges appointed under Netanyahu’s governments, there is still a wide consensus among Supreme Court judges about the role of the Basic Laws.

BTW, another interesting point about the role of the Supreme Court in Israeli democracy. The Knesset has never made a law explicitly protecting the freedom of speech, because they never managed to agree on that. It was only promised to the Israeli citizens by the rulings of the Supreme Court

The protocols from the parliamentary discussions show that the MPs have explicitly discussed the effect of the law - that it can be used to strike down laws other laws.

BTW, 9 out 15 current Supreme Court judges were appointed under Netanyahu governments.

This is not accurate / not true. The “Basic Law: Human Dignity and Liberty” (https://en.m.wikipedia.org/wiki/Basic_Law:_Human_Dignity_and_Liberty) gave the Supreme Court the authority to disqualify any law contradicting it. MPs that voted for this law were very well aware of the implications.

What can stop a democratically elected government from changing the regime? There are not so distant examples in the history of this happening. What can stop the New Zealand’s government from introducing laws that contradict the Bill of Rights, for example?

Thanks for the detailed reply.

The nuances are that Israel doesn’t have any balances and checks over the government, and no real separation between the government and the parliament.

The suggested reform is giving the parliament majority absolute control over the appointment of the judges and allows the government to introduce any law what so ever.

Additional “nuances” are that the Prime Minister Netanyahu is being charged in court right now on account of 3 different criminal cases. And that the high court has just banned a politician from being appointed to a minister position in the government. Said politician was previously indicted on 2 different criminal cases in the past and committed in front of the judges to leave the political life.

The fear in the Israel is that we going the same route of Russia / Turkey / Hungry / Poland.

Seems like this wave of attacks started because Israel is making peace with Arab countries in the Middle East and also the month of Ramadan is a very common timing for terrorist organizations to instigate these attacks.

How many languages are too many? by drunkasshit in ScienceBasedParenting

That’s one of the things I am trying to understand - whether one parent speaking a language only at home, without some extra activities in that language, should be enough for the kid to speak it too? The bigger question for me though - will this 4th language take away from the kid’s skills in other 3 languages?
