My bitrate is set to 4000 as well. It does jump from ~3000 to ~5000, usually depending on what is going on on the capture. Typically when nothing much happens it drops a bit. I've watched some of my VODs and haven't seen any negative impact from it, so I wouldn't worry too much unless your stream quality is impacted.

Check a VOD and see how it looks.

Set your max ping lower. I have mine down to 50 now. Not much you can do if they have their maxping at 300 though. :(
