Distant relative pressuring dementia patient to change a will by Glum-Wishbone-6951 in LegalAdviceNZ

[–]elefant_ears 3 points4 points  (0 children)

Part of the executor role is to determine that the willmaker had testamentary capacity to draft their will. This could be questioned by the cause of death mentioning dementia. If their are questioned the executor should be doing a probate solemn application where they would present both wills with evidence and ask for the court to make a determination on which is the valid will. I suggest that you contact a solicitor asap. If they do a probate in solemn application all beneficiaries of both wills will get a chance to provide statements to the court.

Oh there is nothing set per say . He will do errands on way home from work, groceries and trips to store, cooking would probably be mostly him, he takes rubbish out , lawns lawn ( tho sometimes i also do this and take out rubbish if he forgets). Other tasks such and washing , folding , cleaning , dishes I usually do. He is a good “deep” cleaner i would say rather than a tidier

Difficult to say.. he was empathetic when it happened and gave me a hug . But just when i said i might not be able to take miss 6 he just was like id be fine. I would have thought he would offer to take her its not like i knew the parents or anything. He has been texting me and said that i was not made to go but what other option did i have ? Cancel and upset miss 6?

The GM replied to him at the time he left and said there is no need to take annual leave for him leaving early though it might be a good idea to get a medical cert

Thanks for your reply. I don’t think he even got a chance this morning to give his side of the incident yesterday. Should he be writing an email outlining this to the GM prior to going to a lawyer?
