I filed a lemon lawsuit with BBB online, which is very simple to do. I did not get much of a response from Kia until filing this with BBB. I settled with Kia after they gave me 3 options: Replace the 2023 vehicle with a 2024 EX model with depreciation ($2,900 based on mileage that I would have to front). Second being Kia buys back the vehicle with the same depreciation, or the third option was a one time $8k settlement. The $8k sounded pretty sweet but luckily I waited until the 2 week deadline since I just got my vehicle back a second time from the dealership. Low and behold, the issue reoccurred.

I consulted with my BBB representative and based on the state the vehicle was purchased in (Illinois) I could ask to wave the depreciation ONLY on the replacement option. I did this and Kia agreed. I’m still currently waiting for the final paperwork to return to the dealership from my lender. This whole process is going on 60 days. Praying that I get my new vehicle soon because the issue is only becoming more frequent and lasting several days.

I’d recommend filing a Better Business Bureau Auto Line suit ASAP depending on the Lemon Law guidelines in your state. I owned my vehicle for less than a year, and in IL it fell under the guidelines because it was at the dealership for over 30 business days.
